    How long ago was this? There are time frames to observe when appealing etc.

    Did you appeal?

    Did your company follow due process? Witness present etc.

    It was over the New Years Eve period and yes i appealed and yes my union was involved, and yes my company followed the right process, apparently someone else in the company but working in another dept threw a sickie and got fired last year and he was seen by his line manager so if i kept my job then it would have been one 'one rule for one and one rule for another' .
    I have been told that i have been hard done by, but s**t happens.

    Don't count, each case should be assessed on its own merit. Did the union submit an ET1 to the employment tribunal while the appeals were going on?

    I can only think there more issues than going on other than throwing sickie for it not go to ET

    Issues such as saying you're off sick because you hurt your back at work.

    Going back on topic, don't lie, honestly is the best approach you just need to develop a plan to mitigate the issue as much as possible.

    False info can lead to instant dismissal (and in some cases prosecution) when you get found out. Two instances of dismissal in a row on a cv can really screw you!

    If you haven't done by now, get a session with a job/employment counselor via the job centre to develop that plan, you need to get your cv reviewed anyway, so the topic could be brought up at this point.

    You could state that your job was terminated and expanded a little in the covering letter, but a job counselor should be able (if they are any good) advise how to adapt your cv/covering letters/application form responses to meet your circumstances and each job you apply for.

    A friend of mine was dismissed and she has put something along these lines in her CV.

    "I was dismissed due to ill health, none of which is reoccurring"

    Bit of a white lie, but i thought it sounded quite good.

    i am sure the tribunal would back the employee on this case
    surely for a first offence it should at max gross misconduct resulting in a final written warning.
