Egg debt

Hi All....we had an old Egg credit card debt that was in default and just reaching the 6 year 'fall off' period from our credit rating...so as the default date passed I contacted Credit Expert to request that the Egg default notice and the subsequent Fredrickson claim on the same debt were removed....2 weeks after our request a letter arrived from Fredrickson stating that we had not made an acceptable repayment proposal for this account.

Having checked our credit report today which is completely updated both of these notes have dropped off as they are obviously 6 year old defaulted debts so can you please advise should I send a letter (and if so, what one?!) or should we just ignore it..even though we have been warned that THIS DEBT WILL NOT GO AWAY..funny that, but it has gone from my credit report!!!! Just so you know, we sent a statute barred letter to the same company last year before we discovered this wonderful site after advise from a wonderful debt advisor.

    Hi

    Just because a debt has fallen off your credit file this doesn't necessarily mean you no longer owe the money.

    If for example a person defaulted 6years ago but then had made payments say 3years ago they would still owe the money and the creditor/DCA would still be able to get a CCJ against them.

    However if you are certain the debt was statute barred last year then you only need to send the SB letter to Fredrickson. (did you send the first SB letter to egg of fredrickson?)

  • We sent it to Fredrickson. Egg have made no contact with us since it was originally defaulted on.

    If you are sure its SB then you would want the third letter in this post http://forums.moneysavingexpert.com/showpost.html?p=11571227&postcount=3 and also report them for chasing a SB debt.

    Oh okay - that makes more sense!

    So you want a version of the third letter but you need to substitute the scottish act etc for the England & wales info (which you should be able to work out by comparing letter 1 and 2!). Hope that helps.
