Please help me at a terrible loss!!

FIRSTLY I apologise for the 1st thread being in the wrong place new to this.
Please please could someone advise me I am very worried. I took out a loan with a well know supermarket I had never missed a payment until I became a victim of the recession and faced with no job, i have been getting by with temp low paid work. Due to the debt I was in I contacted CCCS who advised me to offer a token payment until things improved. I did this and was soon taken to court by them a CCJ, the judge increased the offer by £11 per month !. I have paid this regularly as told for the last 6 months and thought it was dealt with whilst I continue to try and increase my work. I have now received an 'Application for redetermination'??? I am terrified about going to court and have no idea what to do? I have been on the various sites over the last few days and have seen some people recommend I send all my details to the court now and ask for this to be attached to the case, showing my I&E and receipts for payments made since the last court hearing. Is is right to do? and should I send a copy to the company acting on behalf of the supermarket? (I ncasso) PLEASE if any one has any advice on what to do and what to expect I would be eternally grateful. the debt due to charges is now £5000 Thank you

    Hi

Did the application for redetermination come from your creditor/Debt agency or from the court?

I think the advice usually is to send an I&E to both the court and to the DCA or solicitor dealing with the case on behalf of the creditor.

If there is a hearing you can opt to go along and take your I&E info with you.

Do you have assets? Could you afford more than the £11 now?

It looks like the court, it has a court stamp on it and their address at the foot of the letter. It says N23 notice of Claimants application for redetermination. Thanks for replying

    Hi

I think this is quite a specialist area and I'm not totally sure what to advise. Hopefully someone more expert will be along shortly so do keep checking back for more responses.

If you have no answers later today just come back on and 'bump' this thread by posting on this same thread again.

PLEASE if any one has any advice
    Hi

Take a deep breath, you've nothing to worry about, these situations come up on a regular basis, it's the creditor being greedy   but they require the courts permission before they can demand any further funds from you.

Complete the application, return and include an up to date I&E, if you have other creditors be sure to include them, a decision will be made by the court, if you disagree with the decision, come back here for further advice

I am so grateful for your help really....
There is no 'application' as such too complete?
It is a one page very poorly printed letter which is my details at the top then
TAKE NOTICE that the CLAIMANTS APPLICATION FOR REDETERMINATION will take place on 15th April at 12pm
    at...The court address
    When you should attend...............

    PLEASE NOTE
This case may be released to another Judge, possibly at a different court

    Thats it?
At the bottom it has in small print the court address and then N24 Notice of CLAIMANTS APPLICATION FOR REDETERMINATION

    Hi thix

I have to go but there are a couple of things that we need before helping you.

    1. Did you admit the debt in the original hearing (probably if you did it via CCCS but we need to know).

    2. Have you got the original default and termination letters the creditor sent out? We need to see thiose to find out if they were legally complaint.

Also do you have any equity in the house?

Where is the redetermination hearing to be held? near you or not?
If you've have not made a mistake, you've made nothing

    Hi RAZ
In answer to your other questions
*Yes went through CCCS and admitted debt.
*I do not have the original letters, being so stressed I didnt keep a paper trail
*we do have a little equitity not much enough to cover this debt, we have other debteors though 5 to be precise so not enough to cover them all
    * The court is the closest to our home
I Look forward to your advise
    Jane
