Hi lilibet,
we included ours, or so we thought, but its been 8 months now and we have not had a single payment since. Maybe they will just assess us at the end of the financial year and pay anything we are owed i dont know, but to be fair we have done nothing to chase them up over it because it was my fault they overpaid and we can manage without it at present
hope that helps a little[STRIKE]Shazbo[/STRIKE]

Hi lillibet, it very much depends on these factors,
when did the overpayment occur
when did they formally ask you to repay.

i had an overpayment that occurred before BR which was included in BR - however i was then told that payments didn't recommence until discharge - i will say though that i never got a consistent answer!0

there is clear guidance here, it is based upon case law

Excellent thanks for that - i have had another session with 3 different offices of the tax credit people today and apparently someone is sending me an appeal form - the tax credit helpline can't restart my payments (i got ED on 4th March) until they have confirmed that the debt is satisfied which no-one seems willing to do!0
