CSA..regards Confident or Actual Address?

If an original "confident "address was provided by a PWC and was totally wrong, and even the CSA Data files show this, than surely these are grounds for getting any arrears overturned, because the NRP was unaware they even existed?

An IMa gets introduced from the outset without the knowledge of the NRP and he only realises several years later that thousands are owed.

Does anyone know if a case goes to tribunal, the NRP provides information which confirms wrong address , the CSA would have to prove otherwise.

Meaning the CSA have to prove the address was correct at the time?

  • I don't have experience of tribunals, but it isn't necessary to go to tribunal to get an IMA overthrown for this reason.

    I have known several cases where it has been found that the address used for the NRP was wrong, and as a result the IMA was deemed illegal and the debt wiped off. It might just be a case of you presenting the facts to a CSA caseworker and they could make the decision.

    you will need to provide concrete proof that you were not at the address they sent the original MEF.

    ie. council tax bills, wage slips, utility bills etc.

    if you provide the concrete proof that the debt is illegal then that's about the only way you can counter a LO application too, so they're stuffed and cant pursue the debt.

    not sure about having a LO overturned on these grounds though. worth fighting though.

    We are talking 1996 here:rotfl:14 years ago.

    If I cannot get my records, how do I get out of it?

    Surely they we can make arranagements in the first instance and get the council to confirm I was NOT at the said address, but at another one?

    Even untility bills?

    What if at that time you have no fixed abode?
