If these people come calling, I know they're not allowed to force entry, but if you leave a window open, they can get into your house via it legally.
However, can they clamber over your garden gate, or a neighbours gate, or fence in order to gain access to the rear of your property? If they are, can they go around your garden takling an inventory, things like wooden sandopits, swings, trampolines, etc? Or do they have no right to gain access to 'secure' sections of your property?

I'm not sure, but I think the reason they can gain access through a window is because the perimiter is broken - like if you leave a door open.
My OH has just started working as a temp postman and he was told if a gate is secured shut (with a brick or something other than a basic catch) he shouldn't force entry and should use a particular sticker and shove it in broken correspondence. I don't know if that has anything to do with this, but it sounds similar.
As for climbing the back fence, in a lot of places one side of the boundary belongs to you and one to your neighbour. If your neighbour gives permission I think they would be allowed to climb it, but again, not sure. You could prob order them to leave your property, but you would have to talk to them for that.Almost everything will work again if you unplug it for a few minutes, including you. Anne Lamott

Are you talking about Bailiffs or just someone visiting you to try and get you to pay a debt?

MoD, People from dca's have no rights at all, or as I think Phil says as much clout as the Avon lady!!
It's bailiff's that can get in via an open window if necessary.
Additionally, most dca's which send letters saying they are sending someone don't, I know some do though so if you have had a letter from one tell us who and someone will be able to tell you how likely it is you will get a visit.0 -

Sorry, no one has sent, been rounf or anything./ Yet. I was just preparing myself and the wife as I am away most of the week and she's a kind soul who'd let anyone in. I just need to know what is what so I can give her soem ground rules as such. I am hoping it doesn't get to that stage as I am still hopeful I can rescue the situation, with a bit of the debtors good will.

If your debts have been sold to a debt collection agency (DCA) then your gonna get threat -o-grams for a long while yet.
I have not paid a debt since december 2008 and they are still sending me letters telling me they are thinking of taking me to court.
They darent really as once a jugdement has been made the repayments are fixed by the judge and cant be moved!!
Oh im going BR in May, its my birthday prezzie from my wife!!

What sort of debt are you worried about? Have you been taken to court for it and if so what happened?
It really is important to know whether you are potentially dealing with a debt collector or a bailiff. Two very different creatures with different "powers" and therefore different rules for dealing with them.If you don't stand for something, you'll fall for anything0 -

Thanks a lot guys. Hoping it will not be as drastic as all that. Hoping to be in a position to pay it all off in Summer. If not, then an offer to pay will be made to all the debtors in F&F.
But in the interim, should I simply ignore all threatening letters unless one is actually a summons?Looking for a fresh start without credit.0 -

In the interim you should probably clear up whether the letters you are getting are from DCAs, or from bailiffs, as you seemed confused on the point earlier and one has no powers to do anything to you and the other has powers to take all your stuff*.

I thought I'd answered that earlier by saying no one has sent letters or threatened to coem around, and that I was working out the best route, which to me, seems to be asking for a hold on paying my debts for 3 months for a sharop intake of breath and some breathing room. I hacve sent letter saying I am struggling, the reasons I am struggling and asking for 3 months non payment without default and then I'll start paying it all off. If they refuse, I guess I'll have to default, anyway, and then see where we are in 3 months...Looking for a fresh start without credit.0
