Petition for Number 10 on bailiff actions.

I am so shocked at how they treat people. My case was actually in dispute with the council of my previous address after I had moved but this did not stop the bailiffs from using all manner of scare tactics to try and get the money from me which also included all manner of illegal charges aswell. This was all despite me being 9 months pregnant. I was also shocked that the council backed up the bailiffs illegal charges when i officially complained on 3 occassions, despite it being their responsibility to moniter them. I wondered how many people are so scared into just paying them without question etc...

SO I have set up a petition and also a blog for visitors to comment on and give examples of their experience with the bailiffs.

    Debt collectors are just the same, as do many companies, they lie to get you into contracts/agreements in their favour.

    The law is however already set, bailiffs have set charges they are allowed to charge for CT collection, there is no arguing it. If they charge it wrong they must without question put it right.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies

    Thats right. They are allowed to charge for 2 visits per debt up to a maximum of £42.50 each. On top of that they can charge for levy fees, van charges etc.

    However, the bailiffs i dealt with charged these levy and enforcement charges (well over £300) before they ad even levied any goods.

    I had to take it to the highest levels as the council endorsed these fees even when it was illegal. All of this on top of a disputed situation which they should also allow for.

    Sorry should mention that the petition is for the following:

    We the undersigned petition the Prime Minister to Enforce local
    authorities to use their own in-house employees on a salary to
    recover council debt.

    Currently many councils outsource the collection of council
    debt to bailiff agencies who are employed on a commission
    basis. As a result, illegal practices within the bailiff
    industry are reportedly rife. Common reported practices
    include:

    Not making the visits they charge for. Overcharging fees.
    Adding illegal fees. Using uncertified bailiffs. Refusing
    payment arrangements. Refusing details that the debtor is
    entitled to obtain. Making false statements. Using bullying
    tactics on vunerable people.

    I have been a victim of the above prctices and despite policies
    in place that hold the council accountable for the bailiffs
    practices, it is often hard to prove or the councils do not
    provide adequate assistance. This leaves the councils in a very
    vunerable position legally.

    In order to protect both the councils interests and the
    interests of the debtor concerned, councils should employ
    in-house bailiffs who work for a salary.

    Ahh, that makes more sense, and i agree the council shouldn't outsource due to the problems commission based businesses tend to evolve around.
