Choice catalogue debt

Afternoon all

Newbie here.

Hope you can assist with a problem i currently have, my mum who use to live with me has recently got really ill (cancer of the brain), so she is in a nursing home. The problem i have is she left behind some debt, some with shopacheck (loan) and about 400.00 of catalogue debt with Choice catalogue. I've managed to scrape together some funds to pay off the shopacheck but now im living alone i can not afford the 400 pounds of catalogue debt which she has run up, How do i stand with this, what would happen if i didn't pay this? as the debt is all in the sole name.

Any help would be greatly appreciated

    Hi Wolfy

You are not responsible for the debt.

If letters are coming to here - You could just write back not at this address. Is your mother is a position to pay off the debt? Do she have any savings etc?

In theory you might want to pass on your mother's new address so that they can write to her there. In reality unless she can afford to pay it I'm sure this is the last thing you would want to do.

Don't open any more letters just return them unopened.

They'll try to find her and if they do they'll write asking her to pay. They could try to get a CCJ but for such a small amount its pretty unlikely.

If they do find her - either write and ask for the debt to be written off due to the circumstances or offer then a token £1 payment a month from her income (assuming she has very little income)

  • Thanks for your reply, the problem i currently have is mum is in a nursing home, for the last 2 weeks she is on strong pain killing injections of morphine, she is quite elderly too. She does have savings but unfortunately due to these being in her name only i have no access to this, i've discussed power of attorney but unfortunately im not sure how much longer she will be with us :(

I would just return the letters for now - you and her have more important things going on.

Trying not to be insensitive but what will probably happen is that when her estate is settled some of the savings will be used to pay off the debt.

If her health does improve then POA may be a good idea.
