The fact is the supplier did not deliver the goods – breached their contract and as a consequence I have a legal right to be put back into the position I would have been had the contract been properly performed.

I know its an old thread but fingers crossed you have an email notifcation of new posts.

You were. You were put back to the same position of having your money and no cage.

    You really are a “MUG……”

    You said and I quote:

Everybody on this forum would love to know how you get on. Don't forget to report back”

You used the word “Everybody” - so I duly obliged.

You now say and again I quote:

“Report back meaning update the thread! “

That’s precisely what I did when I posted yesterday - Simply accept what you said in the past has proved to be totally erroneous and wholly inappropriate.

My claim and counter to Hyperdrug’s defence is rather long – spread over some eight pages – and which I considered would be of interest only to those who seriously wished to read and understand how the law was applied in my particular case – hence I said email me if interested. YOU need not bother – as it is very evident all you wish to do is to start another quite uncalled for and unnecessary wrangle – you are not interested in the facts of law – you just want to cast aspersions.

You now know the result - end of story - period.

    Still don't understand!

I was refunded my money at the time the company defaulted. That was last year

The court awarded me a sum of £141 for ‘damages’ as a result of the breach - that was this month.

Even if you don’t agree I hope you at least now understand

But you didnt suffer any damages.

And quite frankly the judge should be locked up if he has given you £!41 in addition to your flight and court costs.

I have said my last word on this subject - I have filled you in as to the result - amen

You can go on casting aspersions and insults if you wish - it seems those who do simply enjoy getting into disputes - arguments - wrangles - controversies - altercations or whatever

    Good bye.

    :rotfl::rotfl::rotfl::rotfl::rotfl::rotfl::rotfl:

You were refunded your money because you didnt want to proceed at a higher price. Spent even more than the higher price buying it from elsewhere (talk of cutting your nose to spite your face), then sued for the extra costs involved and travelled across Europe to go to court over a company that owed you no money.

You really should throw that allegation at anyone...

Congratulations on winning £141 for 15 months effort. Was it really worth it?

If you have to resort to name calling then that really does show your mentality

If you read what I said then I said 'Everybody on this FORUM'

Unless you actually spammed the complete user base then you failed. The only way a user has to update everybody I.E. make it available to everybody is to put the information in a thread.

Maybe you had better stop now before the depth exceeds the length of the spade handle.
