bank charges

A frined of mine took out a debit card with his bank in 2006, they woul not let him have a credit card as he was on benefits.
But after he used his overdraft he began getting ino difficulties as the charges were astronomical. The bank tells him he actually tookout a credit card so was charged credit card charges...
He knows his is not so as he was on benefits and they would not give him a credit card!!
I have enclosed his agreement they have sent him can anyone give u any advice regarding this debt. He has offered to pay what he spent but the fees they have added on have made the debt too large.

I bank with HSBC and the credit card and overdraft facility is completely seperate to each other.
The application form in the pictures is clearly a credit card which your friend will have applied for and signed up for.
He will have been receiving a bank statement for his bank account (monthly or 3 monthly, whatever way he requested it) and another statement for his credit card every month since April 2006.
So has your friend used up his overdraft facility AND run up a credit card debt as well? Has he been using the overdraft to make the payments on his credit card? Have you seen BOTH statements - his bank account statement and his credit card statement?
