Default from Natwest Advice please...

Hi guys...

So, my first post and it;s asking for help already......haha.

Basically arrived at a point where my debts are ironing themselves out and as such, decided to do some spring cleaning at creditexpert.com

On there I found some store cards I'd not had for years showing... and so wrote off to close them. But to my shock was a file from my Natwest Current Account which I had closed and settled saying it was in satisfied but default.

The story is I moved bank accounts in Jan 2008, and rang to inform them that my overdraft would not be being paid by my wages anymore as it was going to another account. I was told that someone would be in contact with me. I work an unsociable hour job and as such when said person called, I was unable to speak for long and told him a time to ring me back the next day. After a 4-5 days he rang, and again I was working, and so told him that I was disappointed he failed to ring me back when asked, and as a bank employee should be on the ball. Anyway, I told him again it was not convienient to speak and asked he called me back at a stated time the following day. Again.... 1 week passed and nothing, and then the letters began falling through the door. I spoke to Natwest who said my account had already been passed to debt collection agency!!!.. I argued the fact that this wasn't fair as ultimatley their colleague had failed to keep any arrangements. After some 45 minutes on the phone, they agreed to have the account back from the agents and as far as I was told was paying my overdraft off to Natwest directly, or so I thought. Only recently do I find out that Natwest Collections are actually collecting my money under a guise of Triton. So with this information, I saved and saved and saved and paid it off.

Firstly I dont think its fair that the account now shows as default. Does anyone else agree, and if so what on earth can I do about it? and secondly surely some sort of legislation into business practice must cover these people who state they will call you back at the stated convienient time and dont.

As I told Natwest, they aren't some 2 bit company, they are a massive financial organisation entrusted with millions of people's money, and I can't even trust them to call me back... shocking.

    Not sure you will be able to argue on the grounds of whether someone did or didn't call back when they said Dougie.

    Before a default is placed on your account, they need to send you a default notice.
    Did you receive this?

    When you got the overdraft, they probably sent you the T&C. If you have not complied with the terms of the agreement then this breach will be when the default took place. It may be that to have that credit limit you were required to put a certain amount into the account each month.

    The only way i see to take this forward is to check whether you received a default notice giving you 30 days to make payment or not. If not, then they should not have put a default on your account. It is very difficult to argue this and get a default removed though.
