Defaulted Accounts - can they do this???

Been following this forum for a while, but i've now got a little time on my hands to contribute a bit so have finally signed up :)

Heres a quick bit of background to my current situation. Back in 2007 I ended up in a large amount of debt which i was really struggling to keep on top of. Fear of opening letters etc - im sure its a common story. My wife was in a similar amount of debt, but servicing it fine. I spoke with the CCCS who basically said the best solution would be for us to combine our debt and pay them off together. We both wanted to be debt free, so went ahead with this. In total we had about £80k debt! Frightening when you think of it. We have done amazingly well - im very embarassed about the position i found myself in, but extremely pleased with what we have achieved since - we cleared over £20k last year! At this point i would like to say that the CCCS have been really helpful, and i cannot thank their staff enough for their support.

Anyway - we looked into our credit reports recently, and we both have accounts with 'default' against them. Now i expected this for me, but surely not for my wife. She was on top of all her payments, then a new arrangement was agreed via CCCS, and obviously that payment has always been on top. Can anyone tell me if the fact we have an arrangement is grounds enough for a company to mark the account as default?

I also have a credit card where the agreed amount the CCCS pays is above the card min repayment. As a result they have refused to put a freeze on interest. This account is now also marked as default!

Can anyone shed any light on a) if the various financial institutions are allowed to do this and b)if not, is there anyway i can remove the default mark against them?

    If you breach the terms of the original credit agreement then they can put a default onto your credit file.

    It may be that they look at the CCCS dealing with your debts as you ending the agreement which is why they put a default on your file. I would write and ask for an explanation though.

    CCCS were really helpful in giving me advice in the first steps of me trying to even out my debt situation the advice they gave me was invaluable - I woudl advise anyone who si struggling to give them a call if not just for support.

    Hold your position and don't give in to the lenders calls and threats the CCS are there to do that and support you and give you advice it will calm down soon - Keep strong.
