                    Hi ,
I have not been on here for a while but i have been lurking about......well as my title says i was awarded bancrupcy in scotland last week....and i am not too sure how i feel about it....mabye it is because i am not sure what comes next.
I had to apply for my own bankrupcy as i could not go down the LILA route as i own a house with my OH(all be it in massive neg equity:eek:).
The letter i rcvd stated that i would hear from the AIB in 6 months time to review my circumstances and to make sure that they have not changed...i have had no interview, no phone call, nothing, is this how it goes in scotland???
What happens about the house or about a SOA????
So as you can see really not sure what to think(although today has been the first time in a year that i has felt at ease in my own home with out the fear of someone coming to my door asking for me,as before i would not even venture into the front living room in the house and kept myself and the kids in the family room which is at the back of the house)
sorry for the long post but there you have it

            Hi bb,
I had to wait for a charge for payment, but before that i was served with an initial writ just before christmas and then at the start of feb a charge for payment and an inhabition order at the same time(although because i have been awarded BR within the timescale allowed 60 days this will fall off of me )...............i did though have to wait just under a year for the charge for payment:eek:.

            Hi,
we're a a similar position after becoming bankrupt on 22nd Feb (both myself and hubbie). Today my husband received a letter from the accountants that have been appointed to administer the sequestration, asking him to call to arrange an interview. Not quite sure what this means or what he's to take etc. Like yourself we're just not quite sure what's happening???
I'll keep you posted and watch your replies with interest!
PS Glad you are able to relax a bit now especially with your family

            Hiya www
I know from your posts here that you have had a really rough time of it, and that going for bankruptcy was not an easy decision for you. So, I'm glad that you're past all of that stress and anxiety now - congratulations.
It sounds as if you've only just been made bankrupt - but it's still a confusing time. There's no reason why you shouldn't call the AiB and ask if they can explain things to you a bit more.0

Hi there just been reading your posts
am in the same place, my company went into adminastration in april 2008, on the advice of the accountant we went to see i stopped paying off debts and loads as the new job i got and still have only left me with a disposable income of £50 and i have nearly £45,000 of debits ranging from banks loans, credit cards and unpaid council taxes, in the 2 years since i have recieved the odd letter but no one has issued a charge of payment letter and i wish they would as it hangs over me so much i know the debt is of my making but i was paying everthing off fine until my RBS pulled our overdraft and my company closed down.
so i cant pay off these debits, i have changed bank accounts etc everytime i get a letter i call back saying am unable to pay and everone i owe money to have a ins and out form with all my cash flow on it but still nobody has issed a charge of payment
HOW DO I GET ONE ISSUED ?
WOULD LOVE TO KNOW AS SOME FOLK SEEM TO GET THEM FASTER THAN OTHERS ITS BEEN 2 YEARS NOW AND I WANT TO JUST GET THE WHOLE THING SORTED SO I CAN START TO LIVE AGAIN
 HELP PLEASE0

            hi w w w .
i went br last december in scotland through lila route.
ive had 1 letter from aib,no phone call or interviwe.
im expecting a letter this month as its 6months,im still on the dole so i dont think i will have much to write on soa.
what i would say is....keep your details.. date of br,your br ref. number+the name of your aib next to your phone+when your crediteors call tell them all your details with glee +the calls should stop quickly.:rotfl:0

As far as I know, there's no easy way to get a creditor to serve you with a charge for payment. Your creditors all know that, if they do, you will go bankrupt and they will probably get nothing, so they will hang on and hope that your fortunes improve.
If any of your friends or family have lent you money (over £3000), you can ask them to agree to your bankruptcy (creditor concurrence, as it's known) They would have to sign a document on oath in front of a solicitor that they did actually lend you the money and show some sort of proof (a bank statement showing the withdrawal should do). Then you can apply direct to the Accountant in Bankruptcy (debtor application pack 2) for your bankruptcy.
 Assume you've considered Trust Deed?0
