Missing letters....

Hi all,

in process of sorting out financial mess after splitting with partner, however, just about to move property so I need to inform all the necessary people whilst my mail is forwarded on to new address, However a letter addressed to me but with wrong address sent a few days back and has been opened :mad: and pushed through my letter box.

the letter is requesting payment threatening court action, looking at the tone it looks like it's not the first letter sent but it's the first I've seen.

as I live in flats which have a high turn over of rentals I'm assuming others have gone to the other flats but been binned. Where do I stand, as I would have looked to made a payment plan but now been threatened full amount plus charges for letters etc... any advice would be great.

edit..

just looked closer, this company knows my address, but this has come from their head office so looks like a breakdown in their communications, really not happy with neighbours knowing my business (though I'm moving).

    If sending it to the wrong address has caused you distress, you could consider sueing via FOS.

    2.5 Putting pressure on debtors or third parties is considered to be oppressive.
    2.6 Examples of unfair practices are as follows:

  • Cheers for this, I will be writing back to them 1.to give new correct address and 2.) about the embarrasment caused due oto their lack of care whilst sending this notice.

    if they cant get addresses correct how have I got a chance in paying them?!

    Also if someone becomes unemployed, how does repayments of debt stand? is it unreasonable to offer a low payment until new job is found, I don't think I could afford to be able to pay out huge on £100 a fortnight Job Seekers Allowance?
