Desperate help needed

Hi guys,

I'm in a real pickle, don't really know what to do with myself and hope someone here can offer some wise words.

My wife basically booted me out four months ago from the matrimonialy home (not my fault may I say), she doesn't work and I've had to set myself up in a flat from scratch and am still paying the mortgage on the house as she doesn't work.

We've got two kids, one mine one step-child, I'm paying no maintainance at the minute as I'm paying the mortgae.

Basically I'm struggling away while she seems to be living the life of reilly, holiday in Spain last week for example.

I know this is so compex and there are alot of ins and out to be discussed but hope someone here can offer something.

I earn about £1400 a month

paying out the following (possible more than I've forgotten)

Mortgage 460
Rent 380
Council Tax 80
Water 50
Electric 30
Gas 20
Phone/Broadband 30
Mobile 40 (18 month contract which I can't batter down)

Egg loan 150 (8500 debt)
Mint card 30 (1500 debt)
Egg card 43 (2150 debt)

Can't get credit to transfer credit cards to 0% as I've tried a couple already and get turned down, maybe because I'm only at my new flat for a few months.

Hope someone can give me some guidance

    Do you and your wife have any savings or money that you are entitled to?

    Is the house going to be sold or will she re-mortgage (I guess she can't if she doesn't work?)

    I think you need to see a solicitor, you can get 1/2 hour free at some the CAB have lists of who you can see.

    I would suggest first port of call to be the CAB who may be able to point you in the right direction. I can see why you are feeling a tad miffed.

    if she's on income support she will get the mortgage paid after six months. you would only have to pay maintenance for your child which would be 10 per cent of your income, far cheaper than paying the mortgage. £140ish.
    you might have forgotten to add on food, travel, insurances, clothes, entertaiment etc.
  • Make sure you are getting your 25% discount if you are living on your own for poll tax.
    If she is not working she will be receiving income support and as you have left her (whatever the circumstances) they will pay the mortgage. I would stop paying the mortgage, and give her maintenance for the children.

  • You would only pay 10% of your disposable income after rent, council tax and household bills (I'm sure this was how they worked it out when my aunt and her husband split, in fact I think they must have taken into consideration his debts because they only asked him to pay £30 per week for 2 kids) I could be wrong, but check out the CSA website.

    sorry to hear that chicken. i know it's crap you'v ebeen put out the house. first i'd tell your ex to get herself a job and start paying her own way. i'd also get the house sold so you can get your share of the money in it.
    i'd definatly go tot a solicitor and get some kind of financial thing sorted and divorce proceedings underway. it's not fun but it'll get your situation under control.

    saw a solicitor this morning which prompted my post.
    CSA are quoting 15% of my gross income as maintainance, already reduced my council tax, unfortuantely I live in Torquay which has extremely high charges.
    I think eventually the house will have to be sold as she cannot afford to keep it up realistically.
    I spoke to the mortgage company when I first moved out, they basicaly told me the mortgage would have to be paid whatever, so if she can't afford it I have to pay.
    Would getting in touch with my credit card companies help, is there anything I can do.

  • the mortgage company would say that... stop paying and let her sort it out with her benefit people, she wanted the house to herself...let her have some of the worry, you cannot go on like this.
  • I would definately contact the credit cards, and explain the situation, its not like you dont want to pay them, you just can't, from reading other posts on this site it seems the way to go, but I don't know if it would affect your credit rating to ask for a reduced payment for a while, one of the MSE nerds might know the answer, they seem the font of all knowledge!!!
