  • Thanks all for the replies, you've been a great help in calming me down! Spoke to the council yesterday they said it's on hold for two weeks ( We wrote to them with an offer and asking for them to explain the charges etc) they said they will be in touch within the next few days. Rang Duke's to actually check it was on hold and they confirmed it was - the staff there are so snotty!!!

    Kaya - thanks for the advice, I'm gonna look into this today. Now I don't have any receipts or anything to say stuff is mine, would that matter?

    when you swear an affadavit in front of a solicitor/commisioner for oaths you are creating a small piece of law, you dont need any reciepts whatsoever, you are swearing on oath that everything is yours, it is perfectly lawfull for your husband to "give/gift" you(or anybody else he chooses) any or all of his posessions provided that they have not been listed/levied upon previously(which they cant do if you dont let them in), the csa went to the trouble of getting a liability order granted against me in a magistrates court for £20,000, i disagreed with it totally, i have £30,000 worth of vehicles on my driveway which cannot be touched by the law/csa/bailiffs etc as the 20k debt is registered against my name and the affadavit states in law that all the posessions including my home are owned by my wife, the debt is in the name of mr p.****, they cannot take mrs c. ****'s items for a debt which isnt hers as it would be common theft and they would and could be prosecuted in a court of law, the affadavit notify's them legally who owns what, they cannot get round it any way at all and they know it, if i was wrong they would have taken my vehicles six months ago when they sent me the threatening letter, after recieving the affadavit they didn't even bother to visit let alone write to me again, it will cost you only £5 and a trip to a solicitors, what have you got to loose?, i would at this point say "good luck" but with an affadavit you don't need any luck

    Kaya is absolutely correct and raises a very good suggestion - an affadavit giving ownership of the debtor's goods to someone else is a great weapon against bailiffs. The one little thing, of course, is that you must absolutely trust the person you're signing the goods over to, because they really are the owner in the eyes of the law afterwards.

    On the ownership affidavit letter do I insert my name or partners name, he has built up debts in his name which he will try to pay when hes back in work.
