2004 Defaults - Mobile Phone

Hi there experts, i was wondering what your thoughts are on this topic.

Currently i have three defaults on my account from October 2004, the first two are mobile phone contracts with O2. I have contact them and asked or copy bills, copy of the agreement, hey said and i quote " O2 are not in a position to provide you with the copy of the signed contract/agrement" but they can send me the bills, i have told them look i am not paying anything until you send me the copy of the contract and have left this with them.

As the defaults come off my account in 7 months do i really need to be worried.

Also i have a defaul for 80 pound... WHAT i thought ... this is from a catalogue company where the goods were 9.99... again they can not provide me with a POD or copy of any contractual agreement. I spoke to Olga in the fraud department and she told me I HAD to prove i had NOT recieved the goods?????? how do i do that i asked but got no reply... what do i do in this circumstance? write to the financial ombusman?

Thanks for your advise on these two points

    If it was fraud ask for the delivery address, it may not match up to where you live.

    Companies that place defaults must send you a default notice first, if you never got it the default was placed unlawfully and should be removed - example -http://forums.moneysavingexpert.com/showpost.html?p=30208835&postcount=49

  • hey i was just wondering if anyone could help me out
    i have 2 defaults that originally where from o2 for 2 contracts i didnt pay way back in 2003/04 in my skint uni days totally regreating it now as i am looking to go for a mortgage. checked my credit file and the defaults where bought by lowell as soon as i recieved their letters i payed straight away. what i dont get on my credit file there is like a 3year gap between start date and default date? i dont remember haveving the contracts that long. i contacted o2 enquiring this and they said the default information was loaded by lowell and it is now lowell that owns the account. Does this mean lowell defaulted me?? if so how can i get them to remove the defaults seen i payed the outstanding amounts straight away? or how do i get them to stop providing credit referencing agencys with updated information on these accounts since they are paid should that be the end of their link with me?? any help would be gratefull

    Is that the department of people who are frauds? Because Olga speaks rubbish. It is up to the creditor to prove the debt, not for anyone else to disprove it.
