help..debt agency harrasing me

i have since the beginning of January recived a letter from CLose credit management which was given the debt by a loan i had out with close motor finance.
Originally i think i only owed in Septmember around £300 left, but my partner his job and was unable to pay, the debt is now in these months added to £966 which is the demand he got from close credit management.

Some of these charges were for home visits which we never received as my partner has always been in, no card was left to prove this either.

my main concern is since the debt collecting agency took over in January, we have been getting phone calls daily to which daily we have asked for the otiginal credit agreement which they are ignoring and say they have sent on 2 different occasions 2 different callers said 2 different dates.

i am getting extremely stressed is it harrasment they are still calling everyday and that we are going round in circles as STILL not got original agreement..

now got another letter under different name banner jones solicitors warning about court proceedings..WE STILL HAVEN'T GOT WHAT WE ASKED FOR THE CREDIT AGREEMENT.. do i need to also send a letter as this is making me ill..

any advice please!!

    Hi magstar

Have you done a formal written request for the credit agreement enclosing the £1 fee? If not you need to do this (they do not have to supply it if you just ask on the phone). You need to send this letter recorded delivery.

Here is a link to a CCA request - http://forums.moneysavingexpert.com/showpost.html?p=30355981&postcount=8

and here is a link re telephone harrasment - http://forums.moneysavingexpert.com/showpost.html?p=23624437&postcount=2

yes you do need to do in by letter and make it recorded delivery! the templates are on this site, first one you need to send is the prove it, this should put the debt on hold with no further interest added (i believe) whilst this dispute is in place

you can also find a template letter on this site to tell them that they can only contact you by post! which is one i would also send as then you get a full written history of everything that is agreed etc.

unfortunatly when things are done on the phone you have NO evidence of anything so most of the time they will just make things up and say things to bully you

one tactic to try in the mean time is the following.
do you have a dictor phone? or the ability to record a conversation, (dont worry even if you dont as you can still use this tactic as it puts them on the back foot but remember you will have no evidence)

anyways next time they phone you, once they have said who they are etc just ask them to hold on one second, and either get the recording device or pretend to get it, and then inform them you are going to be recording the conversation with them for your records and ask them to please repeat there name position and the company they work for, this will usually put htem on the back foot as they will then be unable to use their normal bully threats and tactics because if you are recording it you would have evidence of inproper conduct on their behalf

on a £100 shop you might on average get 70 items save
    10p per product = £7 a week ~ £28 a month
    20p per product = £14 a week ~ £56 a month
30p per product = £21 a week ~ £84 a month (or in other words one weeks shoping at the new price)
