Stressed out - please help

I am currently on a DMP with Payplan. Recently I had an overdraft with HSBC which has now been passed onto DG Solicitors. I am getting really stressed out as they are sending me letters threatening court action. What should I do, shall I pluck up the courage to ring them and explain I am with Payplan. Please advise as I don't know where to turn. Thanks in advance for your advice.

    I can't offer any advice as I'm not on the dmp route but I'm sure the OD should be part of your payment plan and therefore the solicitors should not be threatening you?

    Please don't panic, you have come to the right place. Take a deep breath, make yourself a cup of tea and try to relax for 5 minutes. You will have some advice soon xx

    if you are with payplan have you contacted them and told them you are being chased?

    it might just be something simple in the fact if payplan have not been informed the debt has been passed on they might not be sending the money to the right place and this could be easily sorted.

    also be aware that a lot of debt collection agencies will try and bully you into paying more when they first purchase the debt, most of the time is is empty threats UNLESS you completely ignor them, this is because they know you cant get blood out of a stone and being on a DMP with payplan shows your willingness to pay it back at the rate you can afford

    anyways just to say it again, contact payplan and let them know whats happened and they should advise you further - thats what they are there for!

    I have debt with RBS and on a DMP with CCCS. They too also threatened court action and he advice from CCCS was to sit tight and not to worry as often this is an empty threat. I wish it was....received court papers 2 weeks ago!!

    We kept contacting RBS saying that we couldn't afford to up the payment as told by CCCS. RBS kept ignoring us and stating they wanted more eventually though they finally went to solicitors and they too were saying about court papers.

    I have still to hand the papers to the court (really can't face it) and after all of this CCCS advised me to admit the claim and up the payment - this is what i wanted to do from when they started with the threats. I just feel that maybe it wouldn't have got to this level if CCCS had let us up they payments. I do agree with CCCS though that if they try this once it can then spiral out of control as they can keep upping the payments and then in turn this could also make the other creditors do the same.

    I have total sympathy with you as i to am going through this as all we are trying to do it pay it off as best we can.

    We have spoken to the RBS and solicitors on numerous times but nothing seemed to make any difference- they just want there money. I have to say that every other creditors on my DMP seems happy with the payments and have had no prolbems at all, so it might just be the RBS!!

    Sorry if this is not what you wanted to hear but they actually did get the court papers to me!! Really scary I know but i will keep up posted on what happens. Basically RBS have said that if we up the payment that will be it so fingers crossed.

    El skinto, the CCCS are completely right, you cannot show the RBS preferential treatment otherwise all your creditors will get narked and want more.

    If and when it goes to court, take the SOA along, RBS cannot have what you haven't got, and the judge will see that, RBS are barstewards if you are in trouble with debts etc, try and not worry about it, I would think the RBS will pull out of taking you to court, it will cost them money and thats one thing they don't have much of, as we the taxpaxer own some of that bank.

    Too true about RBS!!! They sent out sherriff officers to the house with the court papers!!! I need to have the papers back at the court by Thursday!!! I never really thought they would do it either but they did and thats what totally pisxxs me off is that we the tax payer bailed them out but when we asked for help they shut the door!!!

    I totally agree with CCCS but it would have made my life a bit easier just to up the payment. CCCS have done an updated SOA which we are taking along later on today along with the court papers.

    I was meant to go up this morning but all i have done is cry and can't face it so waiting on OH to come home from work and he will come with me.

    El Skinto, I'm thinking of you, honestly I have never heard of RBS taking it that far, is someone going to the court hearing with you from CCCS?

    No no one is coming CCCS just posted he SOA out. Its not an actual court hearing today its just to hand in the court papers so they can look over them. Thank god or i would have been in the nuthouse by now!! You would think it was loads n loads of money to but the loan, cc and overdraft comes to around £8000 in all and they are getting paid the most from CCCS my car is the same amount and they have been great.

    This makes it worse if you haven' heard of RBS taking anyone to court!!

    Because I haven't heard of the RBS taking anyone to court, doesn't mean it doesn't happen, don't worry and certainly don't cry over it, RBS cannot have what you haven't got.

    Why don't you start a thread of your own and ask for peoples opinions, you may get some really useful responses. There are alot of posters on here who are with the CCCS and they may be able to help you.

    Contact payplan, if the OD was included in your DMP they will need to know who to make payments to for a start

    Don't worry about the threats of court action, it's the usuall bully boy tactics

    Chances of them taking you to court are somewhere slim and non and slim has pushed them towards non

    Worst case senario, you go to court, you're with Payplan, (who will go with you),The judge in his suit loks at the paper work, SOA
    And then tells off DG for wasteing his and the courts time :D

    Just keep Payplan in the loop
