Can I claim back excessive credit card charges?

I'm being taken to court by my credit card for non-payment. The court papers say I can either agree and return forms and probably get a paper decision or dissagree and probably end up with a proper hearing. I'm unsure wether I should agree as there are huge charges included in the outstanding balance and if I agree the amount owing then I think I would then be unable to claim excess/unfair charges back at a later date. If I dissagree I'm worried that I could be biting off more than I can chew. Refusing to accept the charges would reduce my debt considerably. Can anyone advise?

    Hey, you can claim them back. Get your rear end over to https://www.consumeractiongroup.com, there is a credit card section there and it will take you thru the process.

    go for it, i couldn't be bothered but the !!!!!!s doubled our debt.

    have you been keeping up with at least the minimum payments on your card? If you have been paying reduced payments then you are in breach of the agreement with the card company and are unlikely to be able to get money back. If its just late payment/over limit charges, not missed payment charges, you should be ok.

    Are you sure?

    I am pretty sure lots of people have claimed fees back from DCAs, I didn't think it mattered if you had paid up or not. Lots of people are using the fees to reduce their current debt while on DMPs etc. I certainly plan to try.
