Here we...go!

Well that is the ball rolling with my debts. I have sent letters to all 5 of my dca's via the information provided on this site and requested copies of my original agreements.

Only 3 out of the 5 have responded to my letter and this is the 14 day today. The 3 that have replied have put my account on hold for 30 days whilst they go and get the information. I am curious to see what they produce if anything.

    If they do not send me what I am asking for or ignore me (after I have followed the guides on this forum and those template letters) can you find yourself in a position where the debts should be wiped out? Also at the end of this, should the DCA send me a letter to confirm that my debts are "satisfied in full" so I can pass this to the credit rating people?!?

    No your debts will not be wiped out!!!. Depending upon what they hold on you your debts may be unenforcable threw the courts but they will NOT stop chasing you to pay up. It will just get passed around the DCAs or you may even get one DCA who takes a chance and takes you to court and if you own any property you may even get a Statutory demand slapped on you.

    Never easy to get rid of debts better sometimes to make small payments until you can make f & f offers. As for your credit file these things are on for 6 years and will not move even if you paid the whole lot off all it would say is satisfied. Probably not what you were expecting to hear.

    I cant begin to count the amount of errors in this advice , `ill leave it for one of the experts....

    I believe there were some recent developments in this area, so the advice that I used to know as correct, may no longer be true.

    Previously, if they were unable to supply a copy of the Consumer Credit Agreement (CCA), then the debt became unenforceable.

    This did not wipe out the debt. It simply became unenforceable. ie, they were not able to demand payment for the debt, but could (if they wished), ask you for it nicely. lol. Legally, you had no obligation to repay the debt, but it would still be marked as a default on your credit file which would be there for 6 years.

    However, as I said before, I know there were recent developements in this area which may have an effect on the above.
