First chance I've had to look through this new version - blimey the amount of time it must have taken, plus I see everyone was reallly good and didn't post to soon. Had I seen you create it I might have been tempted to randomly add a post on the first page :whistle::whistle::D

what a really good thread im new to this but was mooching around because I have just seen I have three defaults on my account (which I am trying to get rid of thru sympathy vote!) and come accross this thread..
it seems quite interesting - but is there a way to do this without getting into default? I.e not stopping payments & offering full & final settlements to creditor if debt is unenforceable?0 -

Hows it going? The thread will be better - still lots more to add/amend but its a blank canvas with everything reserved for the first two pages so should be better than the last one where you had to hunt 100+ pages to get any info!
I am having problems storing the images but may add them to one of my business sites in a hidden area - hmmmm (imageshack keeps going down!).
Nobody posted cos I was clever and block booked the first 35 posts or so - however I started late late at night when most people were in zzzzzz land! :rotfl: :rotfl:

If you already have 3 defaults then part 2 of your post makes no sense - if you want to waste money then send me it and i'll ensure that you are no longer liable for it! lol

Put simply, yes you can send for CCA etc and if it comes back Unenforceable then you can make an offer if you like, but why? Its throwing money at something that is unlawfully eligible to demand the money....? Make sense?
But to be fair not many lenders will accept a F&F offer, usually the DCA's do and also lenders will not agree to removal of default for payment - however a DCA will.2010 - year of the troll

what i mean is, i have three defaults on my credit file for measley amounts (two mobile phone bills circa £50 each and one what i owed bank circa £400) which are all paid so am trying to get them removed... but if they aren't removed then they will be "falling off" credit file in just over a year anyway, which is why im not too keen on getting another default which will last 6 years...
But I am keen on maybe trying this i have an outstanding loan for £11,500 roughly... but don't want the default! :-(
If it went to DCA's would'nt i get a default from the lender anyway, even if I was successful with F&F with DCA?0 -

Apparently we need several people to request it by emailing the site team.... I've asked before, i.e. the first thread had 44,000 views and the second had 90,000 views and this has had 2,000 in the first 2 days!
I personally think it has a lot more need than some of the carp that is stickied but then I would say that as i'm the author.....
If I recall, MSE like to call unenforceability a 'loophole' which I usually have to correct, especially from MSE Guy :mad: :mad: :mad:

If you dont adhere to the agreement , you will get a default in any event at some point from the OC , why would they accept a f&f offer when you are still paying them ?!?
Put simply you wont get a yes to any f&f offer until you have a default and the account is with a DCA0 -
