A 7 year old girl said to me today "I don't know why he's so mean" about a 6 year old boy who hurts animals and swears at her.
I said "because inside he thinks he is a rubbishy person, so when he feels like he's made someone worse than him well that means he is better than them. So he feels a bit better about how rubbishy he is. That's no good is it. When he tries to be mean to you again think about your rabbit and your Mum and your sister and all the things that make you happy instead of listening to him. The people who are really big and clever inside say nice things to other people and help them with things, those are the people to play with, and that's the sort of person to try to be."
I think the credit rules (also known as the law) also apply to the little guy, and I wanna see the little guy on a level playing field. The banks can't expect to enforce on a credit agreement that was always against the law any more than that naughty little boy above can expect a hand-ball goal to be allowed to stand in football.

Hi Nid, after various threats from Cap One (3 days to pay, bailiffs etc), the latest letter was vey polite and said they were launching an investigation and would reply in four weeks...this is from an unenforceable application form, seems strange to me...is this the calm before the storm?0

Gosh , i see i have caused a bit of a stir.
Just wanted to thank all the guys and gals for advice and sticking up for the consumer. (ME)
We have all made mistakes in life this debt and putting it to the side was mine.
I need to have a good old think.
Whats my next step, ? Should i write a letter saying why i believe its unenforceble?

Hi everyone
Out of 7, 2 have not responded to my 1st stage letter. (My fault as i didn't send recorded delivery to any of them)....
As the above 2x that not responded (Other 5, ii waiting for them to send me my agreement - whenever that maybe), and they are handled by DCA, and NOT defaulted, one of them prior to NOT have responded to me since May 2009 which was my old address even though i have contacted them this year with checking that they have my correct address details which they have as i wrote to them umpteen times and spoke to them. They other agreed to recieve £2.00 p/mth as i am still unemployed
Q: is it Best to go down the remidner route (even though i NOT been defaulted?), even though i have been sending the Min payment of £2.00 p/mth (when i get around to it that has been). or STOP sending monies, till they then send me a letter, followed by THEN sending the reminder letter

MR DOLLAR - Follow NID's advice in post #12 on your own thread - send the template letter
i.e. The agreement you posted is unenforceable, the letter they sent really doesn't matter - its just them giving a summary of events to date. However, in the circumstances send the following back to crapquest: Refusal by Lender/DCA - to accept Unenforceability
The reason by the way, that it is unenforceable, is because there are no terms either linked to or attached to the application and certainly no prescribed terms. We can all send an application form out, purporting to be an agreement but it doesn't mean it is enforceable!0 -
even without intrest & charges dont you think the companys should atleast recieve their money back, after all its theirs0

I think you confuse the majority with the very small handful who take out debt with the intention of never paying back. I'd imagine the vast majority of people if not 99%(myself included) have paid back at least what borrowed if not several times what borrowed, only to of paid nothing off. For example on 1 debt I had paid £3500 in a 12 month period only for the balance to be higher than beforehand despite spending nothing on it, by which point it was over the limit and incurring more charges.
I think you confuse greedy creditors with the nice lady in the shop who let you have a loaf of bread on an IOU
I sleep well at night, infact a lot better than without people ringing from the other side of the world and hassling me.0 -

Very well said :T. The majority of us have done all we can to pay off what we have borrowed, but due to changes in circumstances and banks loading on heaps of interest and charges, even when you get in touch to explain the problems, you can never get it paid. We are not trying to find an easy way out because believe me this is not easy, but we support each other.
This thread is a great help and a lifeline to so many. Most of us would be in complete despair without the help and advice of Niddy.:idea: Had lbm, switched it off too many times. Now am trying to sort my life out :T:T

someone extremly close to me is bring harassed by Moorcroft. They have been paying them regularly over themany months,and frequently get calls to up the payment. the OP repeats that is all tey can afford now but still the calls come.With a rough cacluation they recon that the debt has been payed off.Would it be advisable to send them a Prove it or a cca.
