    im back and posting still but i can understand what you have said in post 3693

    i guess some bank staff may have wanted to gain some brownie points, and be showing their employers look what we have found :(

    but hey im thinking that real people will have poured their heart out to you and i guess you have to make a judgement call on that including on me;) that we are for real and i also suppose there is a bit of a trust factor going on here but at times you have to really go with you gut and boy when i havent listened to my gut i live to regret it

    just hope that silly email link has been zapped and thus they have had your message loud and clear - we are with you and i bless the day i reached this thread so many weeks ago that i can finally feel i can breathe again - thank you

    Noticed all documents, so answered them all for you - saves you asking later! :rotfl:

    Tesco - Enforceable. The prescribed terms are on the signatory page! Signature changes nothing - see here for details: #35

    Northern Rock - Unenforceable, no monthly payments showing and no terms attached to it; send this: CCA Query

    M&S - Undecided - so for the time being send this, see what they come back with: CCA Query

    Hi niddy,

    Can I just check something with you?

    I have a debt which is enforceable
    The default has gone from my credit report

    so at the moment as it is not showing on my credit report anywhere it isnt affecting my credit score and they cant default it again as you can only default a debt once so the only other thing they could do to affect my credit rating now would be a CCJ is that right?

    So from your opinion what would be the best course of action that would mean the chances of them applying for a CCJ are lowest:

    1) Blag it (not sure what this involves and dont want to rile them)
    2) Offer repayment

    Am I best off calling them if I go down option 2 or writing to them? They said I had 21 days to reply to them with payment details etc in that letter they sent with the CAA so really I should get in contact with them as soon as?

    As you can probably tell I'm a bit scared of having a CCJ put on and having to wait another 6 years to get a good credit rating!

    I've just been catching up with the last few days posts and came across the one above . From a personal and very selfish view :o I hope you decide to carry on dispensing your invaluable wisdom as you have helped me so much :beer:
    I'm sure the rest of your genuine followers feel the same so please keep up the fantastic work and good luck rooting out the trolls . . . . .you have seen enough of my CCAs to know where I work and that its def not for a bank :rotfl:

    Only you know what you want to do and me thinks you've already answered it so yea, to retain your credit file then you need to offer to repay but it may take you 10 years to clear, or fall into arrears etc - so you have to weigh up the odds. I cannot assist with such a decision.
