    My OH gets rolled up holidays, so the NHS think it is OK.

    I think staff working on the bank get rolled up holiday pay in that there is a separate amount shown on their payslips for hols. It is rolled up in that it is paid at the same time as normal pay but nevertheless shows as a separate amount. Because bank staff probably work irregular hours I guess this makes some sense - so that payroll doesn't continually have to work out their holiday when they say they are taking a (possibly forced) break.

    This is where i go round in circles!! i work as said above mon-fri 6am-8am so 5 days per week (part time). I get 20 days holiday (5x4) (alhough no new contract saying this as have dropped from doing 6 days when i used to get 24 days)

    Dh works full time tue eve, wed day, thur day, fri day, sat day so 4.5 days and gets the 28 days holiday so this is why i get annoyed..he doesn't get any extra for bank holidays though where as i do...but he is full time as opposed to part time like me i'm guessing this is what makes the drop in holiday days?

    One other thing that annoys me is they do an average of what i have worked the month before so say i worke 8 hours in week one and then had week 2 off as holiday they would not pay me for my normal 10 they would pay me for my 8..is this right? dh says yes..

    I dont want to rock the boat as just lost a big chunk of my self employed job and need this one but think some of it is unfair at times.

    It is a private club and they have never done things by the book imo, there have been numerous things come up that i dont agree with but plodded along! been there 11 years now so feel i can say something but want to get my facts straight first!

    Your holiday will only be based on your contracted hours so if you are supposed to work 8 hours but you end up doing 10 (2 hours overtime) you will only accrue holiday on your basic hours.

    I'm still abut confused onthe calculation if days. What are your contracted days and hours?

    HI thanks yes i understand if i do more hours i will only get paid for the hours i am contracted for.
    My days are:

    Mon: 6am-8am
    Tue: 6am-8am
    wed 6am-8am
    thur 6am-8am
    fri 6am-8am
    so 10 hours per week..they times this by 4 hence my 20 days paid holiday.

    Sorry it's wrong. Employees must recieve 5.6 weeks statutory minimum.

    Does your entitlement include the 8 bank holidays? If you do get these off paid on addition to your 20? If so that would explain it!

    If not you should get your 28 days = 56 hours (10 hrs x 5.6 weeks)

    5 day week 2hr per day you are entitled to 5.6weeks so 28 days paid at 2hrs per day. 6day week still only gets 28 it is capped.

    You say you get 20 days and bank holidays which is 28 BUT you also say you work them which you cannot without time off to replace them to make you have 28 days

    Thats your minimum but all workers must be treated equaly within the rules(for holiday).

    What pay does the OH get for a day off? (does he work at the same place)


    Don't undestand the highlighed bit, if you work 5 days a week you get 28 days at 2hr do you some times work less than 5 days(don't count holidays)?
  • Averaging for hours and payrates should be done over previous 12 weeks if they want to use an averaging process.

    Ok think i get it! I work mon - fri making 10 hours per week (2 per day) i am allowed per contract (if they ever do one!) 20 days..i do work the bank holidays as get double pay but at times they will leave a note saying not to work (as they want to save the money!)..so i get that day off paid. This year there are 10 bank holidays form what i can work out..does that mean i am infact getting 30 days off paid?!

    Was talking to the man i work with today and was saying i was considering asking..he agreed as last year i really struggled to take the holiday owed (had more last year) and the year before was the same so not sure i really need it. Dh was saying they may have got them in as outside cleaners which if they are paid by the same co as me can they decline me getting the same system?

    As for dh he works for a similar club but no not the same one..he is salaried though and a different kettle of fish which im not even going to go into now!

    There are 9 bank holidays this year (based on the holiday year inline with the tax year and not including scottish holidays)! The statutory minimum is 28 days per annum but you may have a bank holiday policy in your contract. So, yes, you may get 29 days this year if you dont work any of the bank holidays.

    Regardless of how you are paid for the holiday you must take the minimum 28 days to coply with the WTR. You are also not allowed to carry over any of the statutory minimum days to the following holiday year.

    Regarding the acceptance and decline of how you are paid holiday, the company can do what they like. You can request to change your contract but they dont have to agree to it.
