Hi
I have just received an arrears notice from the CSA for £10500. I have been paying my ex all along directly for the last 9 years and have paid more than this. I have paid her by standing order mostly to her mothers account as she is on benefits. Will the CSA be able to force me to pay this amount?

    If you have documented proof that you have paying for child x you should be ok .I would maybe inform your ex that she has been commiting benefit fraud if she doesn't back you up .

    This is going to be tricky if you have paid money into her mother's account. What did the Standing Order say?
  • It doesn't matter what the standing order said or whether you can prove you paid the PWC direct unless she agrees that you paid her this money as child maintenance, and I imagine this would be unlikely as she would then be admitting benefit fraud - the CSA would have a duty to inform the benefits agency of this if she admitted receiving money from you.

    You're in a bit of a mess I'm afraid. Why did you pay the PWC direct when you knew you had an open CSA case and would have received paperwork instructing you to pay through the CSA?

    You need to provide a little more information to get any constructive advice suited to your situation!
    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.

    If the SO stated child support then it MAY have some standing, but the PWC would have to agree that you paid her the money. If she were asked why she had it paid into another account it may make her crack or go the other way and deny as, if she was on benefits, she should have declared the money and could get into trouble. If she categorically denies getting the money then you will have to pay again.

    Were you aware the agency were involved when you were making direct payments to the PWC?

    When did the agency make first contact with you?

    Put in an appeal immediately against the decision, and provide all evidence that you can, send recorded delivery, and keep a copy file and Royal Mail barcodes, printed off to prove CSA received your correspondeence.

    This will probably be a long fight ahead, but you must appeal
