worried about first direct

Hi all, First direct have sent some threatening letters. We started out DMP 2 months ago & they have send various default letters etc. When we set up the DMP with payplan they advised us to cut up all cards which we did & shreaded. I have today received a letter saying unless we return all cards to them then they will appoint an agent to collect them. What do i do? are they allowed to come around? x

    Just a threat designed to "panic" you.

    FD can (and presumably have) cancel the cards anyway.

    I suppose you could write back telling them what you have done and not to call, but as you've proabaly realised most letters are just ignored.

    In the VERY unlikely event that someone calls, you just tell them what you have done and instruct them to leave. They have no legal authority to do anything else.

  • thanks fermi, i just really worry about balliffs and things im pregnant with a young baby already & it worrys the hell out of me that they will come in and take my stuff! i will write to them, but yes they have cancelled all cards and frozen all accounts x

    Well, bailiffs can only EVER happen if there is a court judgement against you which you have failed to pay the instalments on.

    You are a million miles from that happening at the moment, and it is very easy to stop them anyway. ;)

    So please please don't worry about that sort of thing. :)

    The only people who might call are just 'collectors' or 'agents', and even that is highly unlikely. Should someone call, they have no powers or authority, and you can quite legitimately tell them to "get lost" and even call the police if they don't leave.

    It is tough to deal with these threats/letters when you are not used to them, but you will quickly see how much bluff and bluster they actually are. ;)

    These are just standard collections letters. I have attached a link to the CCCS website that explains the different stages of the collection process for you – might be worth having a read through. Really nothing to be worried about though, standard stuff ;)
