Holidays - OR guidance

Can someone confirm that budgeting for 'holidays' on their SOA's is acceptable for all those going BR or whether holidays can only be budgeted in under exceptional circumstances? I ask because my friend read the guidance in the OR's technical manual and interrupted it differently from me. She felt that it stated that it was only applicable in exceptional circumstances, i.e if you had a sick or disabled child, etc.
The guidance states: -
Previous guidance stated that an allowance for holidays should not be included in the calculation of funds available for an income payments contribution, other than in exceptional circumstances, for example where a dependant was sick or disabled. Whilst extravagance is not endorsed in this respect, it may be considered a reasonable domestic need to allow the bankrupt and his/her family to benefit from a non-extravagant holiday as a break from routine.
Full guidance at http://www.insolvency.gov.uk/freedomofinformation/technical/TechnicalManual/Ch25-36/Chapter31/part7/part2/part_2.htm#26
However, my interpretation of the guidance is that previously it was only acceptable under those circumstances, but now a non extravagant holiday is acceptable. Yes, no?

Nobody seems to question when people include them in the SOA's they post on here though? Has anyone on here actually been told by their OR (in the last several months) that, no, they couldn't include it in their budget?blind-as-a-bat wrote: »yes and no, another inconsitant area i am afraid, some examinors allow it, others dont, its then up to you if you argue the case.

I was not allowed anything by my OR at interview last week, however I do think I'm going to argue the point before I agree the IPA amount. I had put £60 for 3 of us for a week in the UK during school hols.0

Yes, I would argue. The guidance clearly states the OR may consider it appropriate and even gives guidance for the actual amounts that are reasonable. Also, doing a search for some old threads about the subject, someone put down £60 on their SOA, was refused, but when they questioned the OR, the OR said okay, but you can't have that much and they agreed on £45, so definately worth pushing it.Stressed2010 wrote: »I was not allowed anything by my OR at interview last week, however I do think I'm going to argue the point before I agree the IPA amount. We have been allowed an amount for a holiday as well, no bother.
Just include it and see what happens.0 -
I've been allowed £40 for myself. My overall 'Other' expenses are low though. Definitely put it in and see what happens. Good luck.BR 22/10/2009 ED 08/07/20100

Problem is as others said it's very hit & miss as no to OR's are alike...but I always work on the "if you dont ask" theoryWe all die. The goal isn't to live forever, the goal is to create something that will0
