how quick to claim

im currently on cs1 and about to be reassessed,at the same time i want to make a claim as an PWC. if i make the claim now will my CS1 claim get transferred to CS2 and stop the reassessment on CS1?

    I take it you're an NRP as well as a PWC?

    Yes the CS1 case will get transferred over to CS2 but there will be a 5 year phasing of payments...so the CS1 payments won't automatically change into what they should be on CS2 and then you get your correct CS2 payments.

    It's a nightmare from what I hear and there used to be a poster on here who was having all manner of difficulty...he never knew from one month to the next what was getting taken out of his pay.

    Your reassessment on CS1 won't stop. It will get done and then that figure will be subject to the phasing.

    My advice would be to try and get a private arrangement for your PWC monies...and if there is any chance of coming to an arrangement with your PWC for the money you pay to them then all the better and cancel the whole case.

    hmmm not sure what to do now as i think the difference is going to be about a £100 between the 2! the PWC, is highly unlikely to agree to private arrangement as she has suddenly gone off on one!

    how can i be assessed under CS1 when the case will be on CS2 if i make a claim, that means the other PWC will be assessed on CS2 while im assessed on CS1!!!

    how does the phasing work!?

    It's v complicated and I have limited knowledge but will try my best.

    Oky...so you get reassessed under CS1 and lets for arguments sake say it's £100pw...you then claim under CS2 for you as a PWC and you are entitled to £100pw

    But under the CS2 rules (for the CS1 case) your PWC would be entitled to £50pw. So that there isn't a sudden drop of £50 for the PWC it would be phased in until eventually your whole case was under CS2

    So for example....year 1 you would pay £90pw
    year 2 you would pay £80pw
    year 3 you would pay £70pw
    year 4 you would pay £60pw
    and finally year 5 you would pay £50pw

    Your case (as a PWC) would be assessed under new rules and as such you would get the CS2 payment

    Of course the figures I am using I am plucking out of the air and there is nothing to stop you in those 5 years asking for a reassessment. They will assess you on CS1 then assess you on CS2 and then phase in the difference...and if by any chance you had to pay MORE under CS2 then the same rules apply. You couldn't be expected to go from £100pw to £200pw in one fell swoop.

    Your whole case will be on the CS2 system and essentially both cases will be CS2 but the phasing will be done from CS1 to CS2.

    It's very confusing and it's apparantly to protect both parties in the event of a change in figures either going up or down.

    No there isn't one but if you PM Kelloggs on here then she will be able to do a calcualtion for you (she used to work for the CSA and is a CS1 queen:D)
