Ive hit my 1st hurdle with bank charges

Hello and thanks in advance for any help or advice.
I send a letter off recoded to Bacclaycard and recieved their responce today. They have returned my cheque for £10 saying that they do not charge for this info but have said'
Enclosed is a copy of all relevant info from May 2004
Stataements that are prior to this date are not held on a computer system or a structured relevant filing system as they are stores on microfiche in date order and therefore they do not fall under the data protection act 1998. They can be obtained form our customer service dept at a cost of £3 per statement.
Now that leaves me 14 months short on what theys ent me. Does anyone please have any thoughts?

If the microfiche was generated from a computer system then they do fall under the data protection act.0

Have you got any links to this? its something Im looking into for a potential group/class action. I so far have found rather the opposite, as its not a relevant filing system under the act.

I would have thought that they could manually check thos records for any charges incurred, after all under the DPA you are entitled to it.0

The DPA actually says you are only entitled to the Data if its held in a relevant filing system.
Microfiche in the way that barclaycard state they hold the data suggests and the information commissioner has told me that its NOT a relelvant filing system so isnt covered.:beer: Well aint funny how its the little things in life that mean the most?
