hello everyone
i had an issue regarding council tax being referred to a bailiff some months ago, i know i should have paid it. i had a bit of trouble with the company being a bit fraudulent and it has caused me a bit of hassle. i made a thread on a different section and was told off a bit but also saw some sympathetic views and was directed where to post lol

thats the back story but. iv now kinda settled it (well the company is taking payments rather than my stuff) and im trying to work towards a debt free life but the company is still in my mind and i feel that i have just laid over and let them win. the council seemed to want to listen but just seemed to flog me of with excuses and make the company deal with my payments (which i was very grateful for) but what can i do about the companies complete lies and twisted truth

Unless you have all the documenation from the company that you can find where the "allegations" you say happen (not that I don't believe you, just trying to play devils advocate.), then really your chasing your tail,
I know this may not be the best, but unless you can prove it, I think its a case of taking it on the chin and riding above it, and learning from what happened.xx rip dad... we had our ups and downs but we’re always be family xx0 -
i completely see what your saying and i have come to accept that i have lost the battle but what do the debt free users actually do to stop injustice like this? that was a question not a dig!0

Seems like this is only half a thread! I am successfully defeating bailiffs working in my city. Using the Freedom of Information Act I have gotten written information on the Bailiff Service agreement with my city council. In a separate document I have confirmation that the council does not allow their agents to remove goods except on receipt of specific permission in specific cases. The general scenario in my city is that no home has at distress resale value sufficient goods to cover the charges costs, and the debt. This has opened a window for all persons under attack from bailiffs ... even those who have an arrangement and have allowed bailiffs into their home to levy distress ... to become resisters. No-one is obliged by law to allow bailiffs collecting for DEBT to enter their home. So the standard advice is "keep the bailiff out". The notices that they are using are increasingly unlawful in their wording. Recently threats of committal have been made. No one in my city has been sent to jail for non payment. Answers to the FOI act show zero committals in the last five years. The reason for this is that the Magistrates need to be sure that the non payment is due to "wilfull neglect to pay" before they can impose a prison sentence. All the resisters pay their accounts direct to the council at a level they can afford, so if ever a case was taken to court the prosecution would have a difficult time in proving wilfull neglect.pingupenguin wrote: »hello everyone

Using this method we could rid ourselves of bailiffs collecting for debt. But remember I am not calling for people not to pay council tax I am saying that the oppressive charges placed on defaulters accounts by greedy bailiffs can be avoided if you do it right.0 -

Unfortunately pingu, once you let the bailiff in he could charge for the WPO on top of the two visit fees.
What you are suggestig is that he has added a lot of extra fees on top of this?
You need to send a pm to Herbie21 and have a look at her web-site www.bailiffadviceonline.co.uk
Once you have her advice as to what fees are legal, you can then reclaim the fees. you may need to get hold of your local councillor as well.If you've have not made a mistake, you've made nothing0
