Suspension from work

Hi, just a quick question not for me but on behalf of a friend. If you are suspended for misconduct does your employer have to outline the full details of the suspension or are they not obliged to give you full details of the reason for your supsension?

  • Not sure what you mean by full details. Does your friend know what the misconduct allegation is?

    Your friend is aware that they are being suspended for misconduct, it would be common as an example to have added that they are being suspended pending investigation into this. Also an outline of what the suspension means - not a judgement of guilt, being available for contact, whether acceptable to contact others during suspension etc
  • Thanks weak heart - unfortunately she doesn't know what the allegation is. She was basically asked to collect her belongings and removed from the site. The thing is luckily the company she works for have been incredibly supportive, so she has been moved to a brand new site.
    Where it seems a bit bizarre is that not only are they refusing to tell my friend what the allegation is, they won't tell her company either. She has been banned from contact from anyone who works at the site where she was based.

  • Don't understand their reasons for not giving any idea of the nature of the allegations. Can she escalate her request for the reason to a more senior member of the HR team?
  • Tried that even the director of her company contacted the company direct, and they refused to elaborate! Neither the company director or senior HR have any idea what the nature of the allegation is.

    So it's not her employer that has suspended her; if she has been moved to another site - but a client that has asked that she be removed from their site.

    Different issue than being suspended from work.

    How does she know it is misconduct?
  • Zazen999, thanks for your reply the situation is as follows:
    • She a technically a sub contractor her salary is paid by her main company - but all her day to day dealings were with the company that suspended her.
    • The company that she is subcontracted to work for suspended her for misconduct - however they would not elaborate on the details of the misconduct charge.
    • The main company gave her the option of waiting for more details in relation to this misconduct charge and waiting to return to site or for the charge of misconduct to be dropped or to take a new site altogether.
    • The main company are not pursuing the misconduct charge because they think that it has been 'mishandled' by the main company and also because they refuse to share details of what the the issue is.
    • If she had wanted to go through the disciplinary with the company she is subcontrated to she would still be on suspension.
