Solicitor (Chancel search)

Options
Our solictor provided us with a list of general searches which they can do on our property which we are about to purchase.

There is one listed as Chancel search something relating to the Church of England. Not quite sure the purpose of this search, should it be done.

Also I have used websites recommended by Martin Lewis such as risk of flooding etc,

any other points to consider when using a solicitor.

    There is an article on wikipedia here that concerns chancel repair liability. I am sure that your solicitor will be able to advise on the merits of such a search.

    Do you want to pay for the local church to have a new roof in a couple of years?

    You could be wholly or part liable under the terms of ownership of your property, even if it's not recorded on the lease/deeds.

    While highly unlikely, it's not a risk remotely worth taking as any liability could ultimately bankrupt you.

    (Dont't rely on lists and foum answers though - talk to the solicitor and ask the questions).
  • Personally I would have the search done. The cost of chancel repair indemnity insurance is so cheap (ours is £47) it would be worth having the search done.

    The more i read about if from various post the more that I think i will have the search done, will mention it to the solicitor. I will also check if there are any churches nearby.

    I spoke to a solicitor yesterday who said that a new insurer for chancel liability has entered the scene recently offering insurance for around £25 (in perpetuity). Seeing as the search costs £17.63 he said we could just pay the £25 and be covered for ever more with no worries.

    I'm in rural Norfolk so I think I'll go with that option. Does anyone know anymore about it - the name of the insurer etc.?
