    Just out of interest...

    If Dolly, as she has every right to - demanded and got compensation from that collection agency.

    Would she get to keep it.

    I would hope yes - in lieu of distress and suffering.

    (for being deliberately lied to - and because the agency broke every law and regulation that has ever been set).

    Possibly even if not discharged, personal injury payouts do not vest in a BR's estate, if it was classed as that, so are not classed as an after aquired asset nor any other form of income that could be claimed via say an IPA

  • Ive also had this sort of letter from Capital one, I called the OR and she said that its nonsense and I should ignore it, but how can they write to you about them chasing you after you are BR when its wrong to do so

    BR does offer you protection from your debts. Unless you signed an agreement after your BR then there is naff all they can do. What they are doing is illegal and I am bloody cross with them.

    because they will....if they hassle enough people the odd 1 will respond...they never seem to understand the words "bankrupt" unless someone staples a copy of your BO to their heads....if the letters and calls come on a regular basis thenthe OR yourselves & the OFT can be involved to take action against them

    I have to send more proof to Allied (section 4 of BR petition to prove debt was included) by tuesday at the very latest. They graciously allowed me 7 days to do this!

    Somebody remind me what the whole point of the bankruptcy notice in the London Gazette is please?

  • Im now returning Lowells regular letters (a £20 debt, pre-BR) in envelopes with no stamp on them....
