OK, if they've agreed the agreement with PPI was miss sold, that agreement needs cancelling, a new agreement needs to be set up excluding PPI, but including any balance from the previous agreement.

Once the new agreement is set up, if the remaining balance is only made up of PPI fees, these needs cancelling, making a zero balance.

Once that's been achieved, only then can you request the removal of any default notice issued.

Thanks 10 past 6, this pretty much ties in with my thinking, i.e. if i prove that the balance of this account (which was supposedly closed) is 100% made up of ppi charges for a missold policy then once i get the reclaim through i should be able to request the removal of the default.

any idea if this is likely to be straight forward once the ppi reclaim is complete or am i looking at another long slog to get the default removed?

It should be straight forward as you would prove it to the lender first then go to the CRA's with the same and they will remove the default as they wouldn't want to be liable for libel..... just deal with the missold PPi first mate :D

Should be sorted within, what, 3 months so long as you get the FOS involved as this is more fire power to hit the CRA's with....

You have a very strong case going on what you've said. :T

  • Thanks N.I.D. well i have started the ppi reclaim using the info/templates from this site already so i'll await the outcome and then take the fight to em regarding the default.

in the meantime i'll push on with close, i really want these two blips off my file as i have an otherwise unblemished credit file and these two defaults are preventing me from moving house, i'd accept them if i thought they were fair and justified but they are anything but....thanks for the help N.I.D. and 10 past 6......

Start of with the SAR letter, once you've obtained all the a/c info, only then can you hit them with the "Evidence" ;)

It's a long slog, BUT, if your credit rating has been affected (i.e. higher interest rates) due to them issuing an incorrect default notice, you have grounds to make a claim / sue for any losses.

Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies
