Cca request & westcot credit

I am being chased for what was a joint loan by Wescot Credit Services and despite a CCA request on 14th October 2009 and a Section 10 notice of dispute in January this year they still have not sent me any proof they have the right to collect this debt! They also tried the Nelson Guest Solicitors route but did shoot them down right away!

They originally tried chasing both parties for the full amount using two different references as well, and when i wrote to tell them this was very likely illegal they took the other name off and are now just chasing myself!

I have received another standard letter yesterday, still chasing myself only for the full amount threatening all kinds of further action including doorstep visits (even though my original CCA request forbade them knocking on my door)

The debt is joint so they should not be chasing me for the whole amount and they just ignored all correspondance in relation to the CCA request

Not sure where i now stand legally or what to do next. Any help or advice would be very much appreaciated

Thanks in advance

Barry

Sorry, that is wrong. Joint debts are fully liable by both parties. How the debt is paid fairly is upto the joint account holders, the DCA/creditor can pursue either of you for the full amount if they cannot find the other holder, or when the other holder is no longer liable (bankrupt/deceased)

As to the debt been in dispute a complaint to the OFT is the next way to go, if they still have no provided proof. Note. no CCA means no CCJ. They can still add missed payments and defaults to your credit file (although only 1 default per debt allowed)

There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies
