one child has now moved in with me

Hi just wondering if anyone can give me a little advice....

I have 2 children whom i have been paying maintenance for via the CSA, worked out on CS1, the eldest has had a breakdown in relationship with his mum and has come to live with me. I have them most weekends and part of the school holidays anyway. Oh incidently their mother is on income support.

Now ive been looking around for a calculator so i can try to get an idea of what i will now have to pay but i cant find one for CS1 rules.

few questions

1. My son gets DLA will this affect my income?
2. reading around i have kind of figured they will reduce my liabillity by about £30-40.. weird how she needs £260 a month for two yet i will need only £30-40 for one :-/ if thats true!
3. I believe im right in saying if i apply for family tax credit, now im a single dad, they wont take into account the figure as im on CS1 is that right?
4. will they do a re-assessment or will they just deduct an amount for my son
5. crucially is it correct they wont make any changes for 2 months? so i have to still pay her as having my son even though he is now living with me?
6. if i now make a claim for child benefit will that be counted in my income?

    You won't get anything from your ex under CS1 but I have a feeling that you may switch to CS2 and will be subject to phasing if you claim from her. You should claim the child benefit to secure everything.

    Under CS1 they do count your tax credits as income if you are the primary earner. Child tax credits are always included.

    Your ex will have to pay a flat rate of £5 per week under CS2 which won't help you much at all.

    Your son getting DLA will increase your household income if but is not used in the calculations.

    Child benefit is an odd benefit because they don't effect rules immediately - you are correct that usually they don't do anything for 8 weeks.

    The first eight weeks after a child leaves home

    FROM THE INLAND REVENUE WEBSITE:
    If your child leaves home to live with someone like a friend or relative, the Child Benefit Office will usually keep paying you Child Benefit for the first eight weeks. It may be less than this if the person your child's gone to live with also makes a claim for your child.

    If your ex disagrees with your claim, they will suspend it and investigate before deciding who to award it to.

    sothe sooner i apply for the child benefit the sooner they will make the changesis that right?

    also one of you guys say the FTC is counted one says its not!! :cool: how can i find out for certain, i keep reading things about counted but is included in protected earnings im confused!! :-(

    it depends on which tax credit it is and who in the household earns the most money.
  • well i would be the main earner as im single, as for the credit well i dont claim anything as yet, and dont see the point if the csa are going to just take it anyway. which is why i was wondering if it gets used in the calculations.

    what did you mean when you said that the CB doesnt affect things immediately?

    it means that they don't do anything for the first 8 weeks of the child moving out, so you will have a fight on your hands to get your CSA case updated.
  • As someone who's gone through this, the CSA only acted after I had a residence order - Crazy but true. the big issue was that she claimed my daughter was still living with her when I asked for the CB to be paid to me

    I'm stillowed some arrears by my ex :mad:

    I was a NRP, now I'm a PWC, partner of a PWC, and parent of a PWC ( and very confused at times )
  • well this sounds very promising...not!!

    one other thing, if i may, i understand that in april she gets to keep all the maitenance she recieves along with all her benefits. if i make a csa claim against her what income do they take into account?
