                    Hi all,
Ok, not a newbie at this, but just wanted to make sure we have done the right thing and cant do anymore. here goes, basically, hubby and I are doing our own DMP all creditors have been great except Halifax and Egg. However, after a 4 month battle, finally got a letter from Halifax stating they will freeze interest and charges, have accepted our offer and review account in 3-6 months time:j Egg are a different story (they are so stupid). Received a letter from them today stating "you have not responded to our previous correspondence (which we did by the way!!) your account is £216 in arrears, if you do not contact us and negotiate a payment plan with us, we will start collection activities and may take you to court for the monies owed (OH owes about £7200)"
So hubby wrote back to day, stating that we did write to them and enclosed a copy of his letter dated 9th Feb, enclosed a copy of their terse letter above and said again, that we are offering to pay them £150 a month, would they please freeze interest etc etc. I dont suppose there is much else we can do is there? Oh yes, we sent the letter recorded delivery!!! Do they really take you to court when you are offering a good monthly payment like that? or is it just a threat to scare people??? any advice appreciated. thanks guys.:D

I believe it to be a scare tactic. If they did issue at county court, you'd fill in the reply and put down the £150 that you've offered all along and the court would sign seal and deliver that £150 per month as the amount you have to pay, so Egg wouldn't have the ability to ask you to pay any more should your circumstances change - unless they went back to court - where you could ask the court to make an order against Egg asking for all court fees etc to be paid by Egg as they needn't have started litigation as you were willing all along to pay £150.
In my opinion, its a scare tactic to see if you will cough up more than the £150 - don't - stick to your guns and go for it!!0
