For pre-april 2007 agreements, for it to be enforced in court they have to present the original signed CCA that is legally enforceable. Many CCAs are either lost or incorrect, but many are also valid.
The CCA request is for a true copy, this is not an original, so may not have a signature. However OFT states.A copy must be a copy. It need not be exact on immaterial points, but cannot be a conjectured reconstruction.
If the trader has no original copy, the trader will have difficulty showing that he has complied with the regulation by supplying a ‘true copy’, since nobody would know what was in the original
Either way, they have 12+2 days to do this, if not send the reminder. http://forums.moneysavingexpert.com/showthread.html?p=26867787#post26867787
If they have only sent current terms+conditions this is incorrect, send the Query letter. http://forums.moneysavingexpert.com/showthread.html?p=26867797#post26867797

Scan in the documents to the PC, blank out any personal details and post them up. Someone will take a look.
What you are looking for is something like this - http://i30.photobucket.com/albums/c323/warlord2000ad/lloydstsb2.png?t=1266661918
The above is a valid CCA, it is not an application form or terms and conditions, but a legal CCA that lloyds provide. Yours may differ as they change them, as does each creditor but there is certain information that must be contained on the page - http://forums.moneysavingexpert.com/showthread.html?p=26867833#post26867833Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
