    @ anti_she - welcome to this forum. I can tell you that these guys are superb at helping. I haven't given much of an update as my computer broke down, so after setting up again, i would like to add that mackenzie hall have not replied as yet, although the Financial Ombudsman have written to me saying that i have a valid case and that they will be allocating an adjudicator, although this can take upto 2 months.

    Sorry that i haven't been on this forum as i've been busy building a new pc. Anyway i thought i'd update you about my situation.

    Mackenzie have written another standard letter saying that they now confirm that they have received my 3rd complaint on the 08/03/10 and that they will respond.

    But I never sent a 3rd complaint on this date, so i phoned the FOS. The FOS confirmed that they had written to mackenzie asking for the full case file and that mackenzie should not have written to me at all.

    Now my question is shall i ring mackenzie and tell them to contact FOS directly or shall i wait for their 3rd Final Response????

    That's what they want you to do. It's in the hands of the FOS, so let them deal with it. Take a deep breath & relax. I think you're worrying unecessarily. I have been dealing with MH on & off for the last four years. They will do anything they can to frighten you into responding.
    As for the CCJ situation, again, don't worry unecessarily. IF there is one (which I doubt), they would have to go back to court in order act on it, as it has been over 6 years. Given their current conduct, and the fact that they would have to show VERY good reason for not collecting sooner, I doubt very much that a court would find in their favour.
    Make a cuppa, or hang on a couple of hours & treat yourself to a glass of vino plonko!

    NEVER, under any circumstances ring a DCA. They are only trying to get your telephone number so they can beseige you with abusive and harrassing calls.

    thanks very much for your advice. I'll ignore the letter and let FOS handle them now. I'm now 99% sure that they have absolutely nothing on me and if they had, they would have shown it to me by now. All is looking good so far...THANK YOU.

    If they had details they would be on you pretty quickly, why? Because it would be profitable. The longer they wait the more days that pass which means if it was not SB then its moving closer to the SB date.

  • ur sure must be right DarkConvict.

    I don't know if i mentioned this earlier, but when i posted a statute barred letter to 1st Credit about this loan (which was later passed to mackenzie), i also sent them several more SB letters regarding some seperate credit/debit card debts. I never heard from them about these debts as yet...only the loan reply from mackenzie....i can only assume that these debts too must be SB??

    You have no requirement to chase up on it, just wait for a reply if they ever do reply.

    If it is SB they should only send an acknowledgement, if not SB they should provide proof to your liability.
