Help please! Bank inflicted debt

Could someone please guide me down the right lines for a little problem i have with the wifes bank account. Have seen martin on GMTV describing this sort of problem.

The wife swapped her earnings into our joint account and stopped using a nationwide account, she had one direct debit for £2.00 which she cancelled. (sept 2008)

As she had a paperless account, it was some time before we had a statement asking for final settlement in the sum of £230.00 ish. It turns out that the direct debit got applied for, rejected and so nationwide charged £30.00, thereafter £20.00 per month plus interest.

We have now recieved notice of intended litigation (dated 10/02/2010, recieved 15/02/2010, action required by 17/02/2010), regarding debt of £300.00 ish.

sounds like an out of control joke ...please help

    Did your wife write to the company and tell them to cancel the DD? If so, do you have prove?

    Did your wife not write and close the bank account once she changed everything over?

    I would say it was your wifes responsibility to check the account online if you had paperless statement.

    If you cannot prove your wife wrote to the company and cancelled the direct debit, then I would say you have to pay the outstanding sum of money.

    The bank charges in my opinion are not fair and are certainly not justifiable, but the test case was lost and unfortunately it seems banks can charge what they like. You could always phone the bank and ask them to reconsider some of the charges, it can work, what have you to lose?

    Definitely ask the bank to reconsider some (if not all) of the charges. If you make them a reasonable request, you may get a reasonable response. So maybe £30 plus interest is justified, but the rest is ott. Worth a phonecall at least.
