They are ruining my credit file, what can I do!!

I am having a nightmare, up until before Christmas I had a good credit file, I am a director of 5 different companies and have not defaulted on any of my credit agreements.

I applied for an RBS business bank account last week for one of my companies. A few days later I call to find out progress on the account and the girl told me I had been declined. How do you go around getting declined for a bank account with no facilities? - I asked. She informed me that I had a Natwest Account that was in default.. I remembered that I had an old Natwest account that I didn't use, but it wasn't in default, in fact I can't remember receiving a statement for it for months!

So I log into credit expert and see that there is a Natwest account 3 months into default!! What!?

So I go to Natwest to find out about it and it seems it is an old account that they have withdrawn the overdraft facilty on (it was within its agreed limits) and are now demanding £983. OK fine, if thats the case I don't mind paying it off, but you haven't called or written to me so this is unfair. So I tell them that I will pay it off but they must repair my credit file. Anyway after a bit more digging I find that they didn't update my details when I moved, and somehow only updated them November 2009 when I moved in May 2008!

So the manager says that it has been passed over to CMS (Triton credit services which is an in house RBS/Natwest collection center). So I called them and they tell me it has been passed over to Moorcroft Collection agency. So I call Moorcroft and tell them I am prepared to pay off the amount in full as long as I am assured (in writing) that my credit file will be repaired. So they say that if I pay it today, it will be showed as satisfied on my credit report. So I inform him that I want all the defaults removing and I want him to assure me in writing that this will be done. So he goes away comes back and says my supervisor has said that if you pay the debt now we will email you a letter saying you have paid. Anyway I said I will speak to Natwest as they are not helping.

So I call Triton again and the girl informs me that they cannot repair the defaults, they can only mark it as settled. So I insist that she can as there has been an administration error. So she tells me to write in and complain.

The problem I have is that this is still affecting my record and is due to flick over to 4 months default today!!

What can I do? I don't want to pay the debt off as they then will not help me repair my file, but if I don't pay it it will get worse and worse.

I really need some advice.

  • A default remains for 6 years, sounds like you have tried everything id suggest to you tbh. Some will remove these if unfairly defaulted as a gesture of goodwill.

    Hopefully others can advise you as to what to do now!

    Very unusual for a company to tell you why you were refused credit/account too, normally they just state you`ve been refused.

    I think its because they are the same group. Lucky they did otherwise I probably wouldn't find out for another couple of months.

    I really hope someone can help me, it feels like I have done nothing wrong but they are ruining my life!

  • Maybe write to one of the papers advocates? This seems like just the sort of thing the consumer advocates at the guardian would fix with a call to the press office....

    It might be a good idea to pay off the debt to save it going into a 4th month of default and then once you've paid it, write a letter stating that as soon as you became aware of the debt, you paid it, and complain that the default was a result of their administration error.
  • I've decided to pay off the debt to save it causing any further damage. I know this has lost me my bartering tool but I just can't afford for it to get any worse.

    What do you think my best redress is?

    Start by going to the bank and demanding to see the manager. TAke evidence that you informed them of the new address and they fouled up.

    If they do not remove the messages on your credit reference, amke a formal complain demanding that they sort out your credit record and pay you for the damage cuased.
