Allied International No Contact

About 4 weeks ago, Allied International contacted me out of the blue to ask why I stopped making payments to them in December 2004! They were concerned as to why I hadn't spoken to them in 5 years.

Now I did not like the attitude of the guy on the phone and refused to acknowledge the debt or answer security questions. He told me I was being elusive and "action" or "litigation" would take place against me. I was also told my recently widowed mother would get a visit from a debt collection advisor who would wait at the house until I turned up.

Anyway since that call i have heard nothing. No scary man at my mums house (or mine), no letters, no phone calls. Why would they go quiet? Are they planning a court case? The debt is from 2002 and does not appear on my credit file, I am also sure they have added to the original debt.

Should I sit tight and do nothing? or would a letter to them requesting the CCA be a good idea?

    Hi they have gone quiet as they know they dont have a leg to stand on!! if you havent spoken to the company in 6 years or over then they are unable to pursue you for a debt. The chances are they contacted you as a last ditch attempt and say ah yes good morning i am mr gullible and i do owe your company lots of money here let me pay you!
    Others more knowledgeable will be along shortly but for now I should ignore the conversation.

    If they really knew they had something, you would get a court summons, not a threat of court action, they would actually do it if they were sure.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    Just an update. They have just called my mother while I was at work, claiming they have sent me a letter regarding a "serious banking issue" and that I must call them by 7pm in order to benefit from their advice.

    Mum explained I was at work and I would call when I got in. They told mum they did not believe that I wasn't at home and they would call in an hour.

    Mum is going to work, so they can call as much as they want. I don't have a letter from them so they are probably stalling and they are probably hoping I will cave in.

    I have now decided to get the CCA request sent off. In the mean time, if in the unlikely event they do have the CCA and go to court can I stop court action while the CCA request has gone through?

    please do not just post off anything. As pania explained this debt may well be statuted barred, or more likely just about to become statute barred which means you do not have to pay the debt.

    If you write to them you are admitting your liability and they can chase you for the next 6 years, unless you are very careful with the wording. better to do nothing at present.

  • They shouldn't be telling your mom it is a banking issue, anyone can put 2 and 2 together, its a scare tactic. DPA means they can't say anything, other than we will call back later.

    I was paying off this deby until Dec 2004 so I have 10 months until it is Statute Barred, I do however think they know they are on a hiding to nothing and that's why they are suddenly pursuing it again.

    The annoying thing is payment was being made happily until Dec 2004 when they stopped taking the agreed amount that they had accepted with CAB. We did try and restart communication but they werent interested then nothing for over 5 years!!
  • Keep a log of all the conversations and letters you receive. If they continue to discuss it with your mother they're breaching the data protection act as well as oft/fsa guidelines so you'd want to think about filing a complaint against them.
