Company hasn't refunded me and is ignoring all communication.

I placed a telephone order with digico.co.uk and they gave me a specific date for delivery. The item did not arrive so I rang to cancel it. They said that my refund would be back in my account within 2-3 working days. This was 6 weeks ago and they will not acknowledge my contacts by recorded letter and email. Without written proof of them giving me a refund, my bank is unable to sort this out through visa for me.
Do you have any advice for getting my money back as £370 is a lot of money for me to lose being a student nurse. Plus I am not going to give this company the satisfaction.

    Did you pay by credit card or visa debit?

    £370 sure is a lot of money & if you paid by credit card then it will be easyu to get a refund by quoting section 75 of the consumer credit act at your card provider which makes them jointly responsible for any item which does not arrive or is not as described:

    Did you pay via credit card? If so contact your card issuer and ask them if they will start a chargeback to refund you. Just explain everything to them and they should do - provided of course you paid by credit card! If it was by debit card and they havent refunded you, tell your bank it was an unauthroised transaction and you could always take it further if you wanted - they may start moving then!

    I've contacted them twice and they say that visa won't do anything as I cancelled the delivery/contract. Been digging around (now I've calmed down a bit) and found the section 75 bit about defective service. Would distance selling regs also cover my cancelling the agreement? ie 'cooling off' period.

    Edit: Still not calm enough to ring them back yet.

    They also said they couldn't do anything without getting the refund in writing, but the retailers are totally blanking me.

    Also do some detective work with http://www.companieshouse.gov.uk/
    and b4usearch.com etc and see if you can trace important people who work for the company and make some personal phone calls.

    Right, spoke to the bank again and they played dumb about these regulations. I go put through to a supervisor who also tried to play dumb (I appreciate that legally they have to be careful what they say when they're being recorded)I told them I wanted my money back and they could claim from visa under these regs, they put me on hold for a VERY long time and eventually came back quoting the t&c's of digico. I told her I was looking at the DTI website, lol. She eventually said that I should send copies of correspondence I have sent to their Visa disputes dept which I will do now. What is the likelihood of them saying no? If they do, what then?
    I've also contacted trading standards and reported the company.

    They won't say no because by law they can't.

    You paid for goods. You didn't receive goods. Digico won't pay up. You contacted them for 6 weeks without luck. So the credit card company are by law obliged to pay up.

    I have claimed twice before using Section 75 from Barclaycard & each time it took 2 months to get a refund from them but eventually I did get it.

    You can go back to the bank and simply say that the goods were ordered and then never delievered and since which you have been unable to get any response to communications.

    I reported them to RETRA ( http://www.retra.co.uk/) and have magically recieved my first comms after retra wrote to them. Lets hope this gets things moving.

  • Finally got it!! Bank (eventually and after 2 arguments and much quoting of my rights, on the phone) gave it me last week and just had an email from the company saying it has been refunded. Thanks guys!
