£10,000 Debt - Help Required

Hi,

I have had a debt with Natwest for four years now which was passed to their internal DCA (Triton) about three years ago now.

I have had various arrangements with Triton with regards to monthly payments, the latest arrangement was for £100.00 per month for 6 months (expired last month)

I have received a letter from them stating that the current agreement has expired and that i have an outstanding balance of £798.00 which requires immediate payment, and that i should seek advice with regards to the debt.

I phoned them last week stating that i can still only afford to pay £100.00 per month and they have refused and said that they require £350.00 minimun payment a month for this account?

Bit stuck of what to do as i can't afford to pay £350.00 a month, the max i could pay is £150.00 per month??

    As we always say they can't have what you haven't got.

    I would simply write (not phone) to say your cirumstances have not changed, you can afford £100 (or whatever) per month and then make sure you continue to pay it. They are just trying to bully you.

    The debt will be paid off in 8months anyway, you can't afford anymore, they are not allowed to suggest you borrow to repay, the account will already be defaulted. Essentially there is nothing else they can do really.

    They (probably) wouldn't be foolish enough to try to apply for a CCJ for the sake of 8months and £798.

    Just keep everything in writing and refuse to talk to them on the phone.

  • Thats the thing i havnt defaulted on the account, last payment made was 27th January for £100.00 (as agreed withe them), as usual i was going to pay £100.00 on the 27th Feb, but then this letter turned up just stating amount owed £798.00 (the balance on the actual loan is about £8300.00 lft to pay)

    Ah sorry.

    Well then I guess they could default you, and could try to get a CCJ against you.

    But still if you don't have the money to pay the full contractual amount anytime soon then I guess you will almost certainly be defaulted sooner or later. I'm suprised they haven't already. Some would argue sooner is better as the sooner you get the default the sooner it will clear from your file (allbeit in 6years time).

    Have you had an professional advice from one of the free organisations? Do you have other unsecured debts?

  • I havnt had any advise, no that is the only debt i have currently got outstanding. Whats the best next step to do?

    Should i send a letter stating that i can only afford to pay a maximum of £150.00 per month?
