Should she be paying

My girlfriend has two school aged children from her ex-partner, she as the kids 9 days out of 14 days, he as them 5 out of the 14 days. She receives the child benifits and family tax allowance but gives half the tax allances to her ex-partner. He pays her nothing, they are both working with him earning more than her. At the moment she as very little spare cash, what should she be paying or recieving to her ex-partner.

    she should be receiving the child benefit and the tax credits to herself
    he should be paying CSA of 20% of his net income less 2/7ths (as he has them in excess of 2 nights per week)

    The system favours the parent with care and if you can come to a friendly agreement then all the better, maybe if her ex was aware of what could happen - worst case would be if she contacted the CSA and they would base it on the formula above, he may at least not take her benefits from her.

    My daughter and ex have a little boy, ex works full time and has son 3 nights per week (he is a good daddy) daughter works part time and receives the CB, tax credits etc. Ex is currently struggling as he gets no help with rent and is on a low income, I have advised her not to push it too much as he is a good daddy and she is financially better off than him and a good relationship is worth more than fighting over a few £ per week but she certainly does not pass over the benefits as she needs every penny.


    another thought : In cases where there is shared care 7/14 each it may work with each parent claiming CB and Tax Credits for one of the children each

    Why is she giving him any money at all?? as Caz says, they should have an agreement and work it out in a similar way to the CSA.

  • I think this is the aggreement that HE wanted, he was violent in the relationship. His communication with my girlfriend reguarding the kids is poor and he is still rude to her (when I'm not there)

    Obviously if he is getting money off her! She is the PWC, she has to provide the majority of the time, he should be paying her money.
    I think she needs to re-think the agreement.
