Temporray worker and holiday entitlement

Hi there,

Can anyone give some advice.

Temporary worker on a 36 hr a week, 6 month contract, I appreciate for temps the holiday leave has to be earned, and I know that the minimum entitlement is 28 days (of which bank holidays etc need to be taken out of).

So am I right in assuming that for each month that the temp works thier full hours they would be entited to 2.333 days holiday?


Or am I missing something really basic here?

  • Pretty much yes. I phone my consultant to check how many days I've got left and to book holidays, simple as.

    I earn a little bit more than 28, I think I get 31 days. It depends which agency you're with really.

    Yes you are exactly right. 5.6 weeks holiday is the statutory minimum, different places may accrue holiday differently ie in days or hours but effectively it all equates to the same.

    Thanks - thats what I have been doing, I was trusting the recruitment agency, and for some reason late last night I had a thought that it didn't add up.

    This is where I get confused, I had worked 158 hours up until last week and asked if I had any holidays I could take and was told 1.5 available, by my reckoning I should have had 2.35?

    So I think they are only giving me 18 days and holding back the other 10 for bank holidays etc, which I appreciate is what happens in a permanent position, but dependant on your start date on a 6 month contract you could in theory only have 4 bank holidays - am I making sense or being completely blonde?

    I understand what you are saying about the bank holidays and it will depend completley on your contract as to how holidays are accrued. Lime you say someone who is there for the full year working 5 days gets 28 days a year. But some will accrue at 2.33 days per month, some at 1.67 days + bank holidays when they occur, some at 12.07% of hours worked and so on. How holidays are accrued depends on the employer, as long as it all equals 5.6 weeks per annum.

    Do you have a contract or something detailing the particulars of your employment?
