Aol, Roxburghe and David White

Apologies for posting this twice but I thought I may get some quick help on this board.... Here is the condensed version....

Ok...I am now officially losing it with the above!!! Over a year ago we cancelled our contract with AOL and recieved a MAC code to enable us to change our internet providers. This was done without any hassle and we thought no more about it...

Around 2 months ago we started to recieve letters from Roxburghe demanding money stating that we owed AOL for broadband and that AOL had passed the debt to them......We never received a single call or letter from AOL and the letters from Roxburghe all have the wrong address on them (as in one we have never given AOL....just a hash of our address, mispelt but as we are so rural, it would manage to get here)

We contacted AOL, who have apologised profusely and stated that they would cancel the debt and that we owed no money, also giving us a code to give to Roxburghe should they hassle us again.....well we thought that was the end of it....So when they wrote again, we gave them the code and asked them to call AOL.....End of it? Not a chance!!

Today we got a letter from this so called solicitors demanding money or else the bailiffs are calling.....I am absolutely furious...Where do we go from here???? Even if Roxburghe eventually drop this, I want to complain as I cannot believe that they are allowed to act in this manner!!!!

(I can't sing the praises of AOL enough, who have tried and tried to help and have sent us copies of correspondance with Roxburghe, they are as exasperated as we are....)

  • Sounds like AOL haven't cancelled it with Roxburghe. I use Roxburghe myself and the only way they will stop is if the selling company 'buys' the debt back. In my case, I have an update weekly on the progress of all debts Roxburghe are chasing, and should there be any queries from the debtor, Roxburghe will contact me to request further information. I can either cancel the debt, thus ending any further correspondance from them, or provide them with the details the debtor is requesting.
    In your case, if you have provided them with a code AOL have provided, then AOL have not confirmed it, so therefore as far as Roxburghe are concerned, the debt is still there.

    They cant said bailiffs unless they get a CCJ in court, and they won't get a CCJ as no debt exists.

    Send them a 2nd letter, basically just restating the first letter. But also add in OFT guidelines that they have broken, and that you have lodged a complaint with the OFT for their actions. Guidelines - http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf

    False representation of authority and/or legal position
    2.3 Those contacting debtors must not be deceitful by misrepresenting their authority
    and/or the correct legal position.
    2.4 Examples of unfair practices are as follows:
    b. falsely implying or stating that action can or will be taken when it legally
    cannot, for example, referring to bankruptcy or sequestration proceedings
    when the balance is too low to qualify for such proceedings or claiming a
    right of entry when no court order to this effect has been granted - They cant send bailiffs
    f. pursuing third parties for payment when they are not liable - AOL admit the mistake

    Deceptive and/or unfair methods
    2.7 Dealings with debtors are not to be deceitful and/or unfair.
    2.8 Examples of unfair practices are as follows:
    i. failing to investigate and/or provide details as appropriate, when a debt is
    queried or disputed, possibly resulting in debtors being wrongly pursued
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
