internet jeweller wont give a refund.

good morning everyone.Ive bought a ring from a online jeweller called nuttalls of chester.was £300 reduced to £128.It wasnt very good so i want to return it.when i e,mailed him he said he wont ,refund mastercard but will swop for other ring.he says i commissed the ring which i never.please advice me what i can do??thanks tony.

Ask your credit card company to refund you, say the item was significantly not as described and not worth it.Owed out = lots. :cool:0

proving what something is worth is difficult, as its a piece of jewellry that probably wasn't mass made it is only worth what someone pays for it.
If you have recieved this item within the last 7 working days you can return it under DSR (Distance Selling Regulations).Always ask ACAS0 -

OP you have 7 working days beginning the day after you take delivery to change your mind and request a refund under the terms of the distance selling regs. If you emailed within that time then you have the right to a refund (although I'm not sure if this ring was custom made for you in which case you may not have that right). If you didn't email/contact the jeweller within that time then they are perfectly entitled to refuse a refund unless the item is faulty.0

If the ring was on the site advertised at a reduced price, then it was already in existence, and very unlikely that any court would agree that it was commissioned in that case.0

ps-LOVE their t &cs where they say you shall not cause,nuisance,annoyance or inconvenience to them!! They also say if you don't agree to their t &cs don't use their site.That doesn't mean they can make it up they go along.
