I know this is probably not the right thing to be asking but my house has been repo and im just about moving out but when i fill the forms in would it be wrong for me to put my mortgage address as a contact address instead of the possible rented address that i might be moving to?
The landlord and agents dont know that i may be going br and i know i should of said something but im so scared but surely if i put my mortgage address down they would be none the wiser?? i havent been given a date to move out of my mortgage property yet so as far as they are concerned im still living there.
Do they do checks on where you are living and your address or anything??

Hi Hun.....firstly sorry to hear about the repo...its a stressful & upsetting time as many on here will testify.
Put on the form the address you are living at now.....obviously if BR is the way forward the Official Reciever will need the actual residential address anyway as will the court on BR day. If you are intending a mail redirection then all post will redirect to your new home address anyway & you can update details at that point.
To be honest I have not informed my letting agents of my potential BR as ...well until it happens its not set in stone. Most letting agents are only concerned if you are behind with rent etc..
Is repo a certainty? ....sorry if I missed previous posts.

yes its def going to be repo, there is no way i can afford it on my own and my ex husband has left me right in the muck with it all. im just scared of being in a rental property then they find out im br and then they say right you have to leave!! if i moved just before i went br but had filled the forms with my old address on would it matter as long as i updated them afterwards?? would the or still contact the agents once i gave him my new address or would it not matter at that point????

When you go to court you have to put the address where you are actually living...you swear to the accuracy of the information so you have no choice there.
If you have passed the credit checks & found a new property then that side is done...sometimes the OR does`nt even contact the letting agents anyway....however this is down to the OR.
Is there any clause in the letting agreement about BR? often there is`nt...I`m in my 3 rd rental now & none have had BR clauses in them. You can get a copy of the agreement by asking the agents to send you a blank one so you can read it .
Letting agents want good tenants....there is a glut of rental properties so most agents will want a good tenant to stay in the property .
Have you spoken to one of the debt charities CAB.CCCS, Nat Debtline?

You must put the place you are living at the date of the bankruptcy on the forms. So if you have not moved on that date you put the old address, even if you are intending to move. If you have already moved on the court date you must put the new addressHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

We moved into rented last year, when our house was repo. We were honest with the letting agent about the state of our debts and had to pay a double deposit. Our intention was to go bankrupt but at the last minute Kensington wanted to do a deal and gave us the house back (gave the neighbours something to talk about). When we were moving back and checked tenancy agreement there was a bankruptcy clause in it, so just check yours first if there isn't there is nothing they can do.
I wish you every luck, your on a roller coaster at the moment, but it will get better.

We told our LL as I did not want him to find out from the OR. He was absolutely fine about it and said as long as the rent was paid and house looked after he was not bothered. I did this even though there was no mention of BR in our tenancy agreement. About 5 weeks after we had gone BR, we received a phone call from the LL to say that the OR had been in touch with him and to thank us for being upfront with him. As long as the rent is paid and you look after the house, you should be fine.:pB&SC No. 298

thanks guys, i think im just so scared of the ll saying right thats it you have to leave, i have looked at the details of the tenancy and there is no mention of bankruptcy so thats a good thing???
I have been planning to go br for so long but i know im going to have to do it before the end of march and im absolutly petrified now!!!!
I just need to sit down get all my paperwork in order and then take one step at a time, easier said than done though when your head is wizzing with a million things.0 -
yes thats a good thing over your tenancy agreement.
My advice would be do it sooner rather than later, the stress of the last two years has really took it out of me, I went bankrupt yesterday and the judge and his clerk were lovely I was just an emotional wreck. Today I'm feeling rather like I've been hit by a hammer lol. I am so tired its unreal, think its probably the reality of it all because it still doesn't seem real.
